A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, APPROVING, SETTING FORTH
AND SUBMITTING TO THE ELECTORATE PROPOSED
CHARTER AMENDMENTS, AMENDING THE CHARTER OF
THE CITY OF OPA-LOCKA, FLORIDA TO: 1) DELETE
SUBSECTION 9, OF SECTION 185, SUCH THAT UNION
EMPLOYEES SHALL BE CLASSIFIED EMPLOYEES; 2)
CHANGE THE NAME OF THE PERSONNEL BOARD TO THE
"CIVIL SERVICE BOARD"; 3) CHANGE THE NAME OF THE
PERSONNEL DEPARMENT TO THE "HUMAN RESOURCES
DEPARTMENT: 4) SET COMPENSATION FOR THE MAYOR
AND CITY COMMISSIONERS, INCLUDING DEFERRED
COMPENSATION; CALLING AND PROVIDING FOR A
REFERENDUM AT THE PRIMARY ELECTION TO BE HELD
ON AUGUST 24, 2010, FOR THE PURPOSE OF SUBMITTING
SAID CHARTER AMENDEMENTS TO THE ELECTORATE AT
SAID REFERENDUM; FURTHER DIRECTING THE CITY
CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN
RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF
ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Opa-locka has determined that it is
in the best interests of the City for certain Charter Amendments to be submitted to the
electorate at referendum; and
WHEREAS, drafts of the proposed Charter Amendments are set forth in final form in
this Resolution, said drafts to be submitted to the electors of the City by means of the herein
Resolution; and

WHEREAS, the proposed amendments shall be submitted to the electorate at the
Primary election to be held on August 24, 2010, as called for and provided herein, and shall
become effective upon approval by the electors:
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA:
Section 1. The recitals and findings in the preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this section.
Section 2.
a) Article XIII, Section 185 of the Charter of the City of Opa-locka is hereby
proposed to be amended in the following particulars:
Sec. 185: Civil Service: subsection 9 shall be deleted, such that union employees shall
be classified employees.
b) Article XIII, Section 181 of the Charter of the City of Opa-locka is hereby
proposed to be amended in the following particulars:
Sec. 181: Personnel Board. All references to "Person" shall be changed to
"Civil Service Board".
c) Article XIII, Section 179 of the Charter of the City of Opa-locka is hereby
proposed to be amended in the following particulars:
Sec. 179: Personnel Department. All references to " " shall be
changed to "Human Resources Department".
d) Section 7 of the Charter of the City of Opa-locka is hereby proposed to be
amended in the following particulars 1:

Sec. 7: Mayor and commission compensation. Compensation for the mayor and
commissioners shall be set at FivdFifty Nine Hundred dollars ($550.00) ($900.00).
per month. The Mayor and Commissioners shall also receive deferred compensation in the
amount of Seven Thousand Five Hundred Dollars ($7,500.00) per year during each year of
service, said deferred compensation to be paid by the City into a duly qualified retirement plan.
In addition, any member of the City Commission (including the Mayor) who shall have
completed eight (8) years of service on the City Commission, shall be entitled, upon leaving
the City Commission, to receive health insurance benefits (as received by other City
employees) for themselves for the remainder of the fiscal year in which their service ends.
NOTICE OF SPECIAL MUNICIPAL ELECTION
TO BE HELD ON
TUESDAY, AUGUST 24, 2010
IN THE CITY OF OPA-LOCKA, FLORIDA
PURSUANT TO RESOLUTION NO
A special municipal election will be held on Tuesday, August 24, 2010 from 7:00 a.m.
to 7:00 p.m. in the City of Opa-locka, Florida, at the polling places in the several elections
precincts designated by the Board of County Commissioners of Miami-Dade County, Florida,
as set forth herein, unless otherwise provided by law, for the purpose of submitting to the
qualified electors of the City of Opa-locka, Florida, the following questions:
Question 1: Shall Article XIII, Sec. 185 of the City of Opa-locka Charter be amended
by deleting subsection 9, such that union employees shall be classified employees.

Charter Amendment No.1, commencing August 24, 2010, provides for subsection 9 of
Section 185 of the Charter to be deleted, such that union employees shall be classified
employees.
Charter Amendment No. 2, commencing August 24, 2010, provides for all references
to "Personnel Board" in Section 181 of the Charter to be changed to "Civil Service Board".
Charter Amendment No. 3, commencing August 24, 2010, provides for all references
to "Personnel Department" in Section 179 of the Charter to be changed to "Human Resources
Department".

Charter Amendment No. 4, commencing August 24, 2010, provides for the
compensation of the Mayor and Commissioners to be set at Nine Hundred Dollars ($900.00)
per month, together with deferred compensation of Seven Thousand Five Hundred ($7,500.00)
per year and health insurance benefits for Commissioners leaving office after serving eight (8)
or more years for the remainder of that fiscal year.

Section 3. The official ballot to be used at said election shall be in full compliance

Section 4. The City Clerk shall cause to be prepared absentee ballots containing the
question set forth in Section 3 above for the use of absentee electors entitled to cast such
ballots in said municipal election.
Section 5. DEBORAH S. IRBY, the City Clerk of the City of Opa-locka, Florida,
or her duly appointed successor, is hereby designated and appointed as the official
representative of the City Commission of the City of Opa-locka, Florida, in relation to matters

pertaining to the use of the registration books and the holding of said special municipal
election.
Section 6. The City Clerk shall deliver a certified copy of this Resolution to the
Supervisor of Elections of Miami-Dade County, Florida.
Section7. This Resolution shall become effective immediately upon its adoption.
