HomeMy Public PortalAbout08-04-17a The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting April 24, 2008, was held on Thursday, April 17,2008, 6:00 P.M., Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: Councilmember Vincent Bellino " Iris Colon " Susan Naples " Joseph Sitarz . Noted absent was Mayor Daniel J. Reiman. Also noted absent was Councilmembers Jorge Diaz and Randy Krum. Also noted present was Municipal Clerk, Kathleen M. Barney and Borough Attorney Robert J. Bergen. Due to the absence of the Mayor, Council President Joseph Sitarz conducted the meeting. The Clerk stated that on Decembl"r 31, 2007, the 2008 Annual Meeting Notice was published in The Home News Tribune, The Star Ledger and posted on the Bulletin Board. April 17, 2008 AGENDA MEETING NOTED PRESENT NOTED ABSENT - MAYOR REIMAN ALSO NOTED ABSENT ALSO NOTED PRESENT CONDUCTED MEETING COUNCIL PRESIDENT JOSEPH SITARZ ANNUAL MEETING NOTICE I APRIL 17, 2008 SILENT PRAYER & PLEDGE OF ALLEGIANCE The Meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by COlmcil President Joseph Sitarz. MINUTES APPROVED Upon MMS&C by Councilmembers Bellino and Colon and unanimous affirmative vote of the four (4) members present, the Minutes of March 6th and April 3'd, 2008 were approved as transcribed and engrossed by the Clerk. PRESENTATOPNS (next meeting) . PRESENTATIONS: Council President Sitarz stated that they had presentations that will be done at the next meeting. a) Rededication of V eterans Field ~ Civic Center Sports Complex b) Senior Tax Help Volunteers JRDINANCE - PUBLIC HEARING ORDINANCES: Public Hearing ~ April 24, 2008. Council President Sitarz said the Ordinances for Public Hearing will be held April 24, 2008. 1. #08-11 Amending & Supplementing At1icle VI Entitled, 'Fees' of Chapter 160, Land Development. 2. #08-12 Amending & Supplementing Chapter 109, Entitled 'Uniform Construction Code', Re: Fees 3. #08-13 Amending Article I, Traffic & Parking Regulations, of Chapter 254 Entitled 'Vehicles & Traffic' of the Code, Re: Limited Parking - Washington Avenue. 4. #08-14 Amending Code, Chapter 247, Entitled 'Trees & Shrubs'. 2 April 17, 2008 5. #08-15 Requiring Commercial & Retail Propel1ies to Maintain Operating Exterior Lights During Certain Periods. #08-18 Amending Chapter 164, 'Licensing Procedures' of the Code, Re: Investigation of Applicants. #08-20 Amending Code, Chapter 71, Re: HotellMotel License. ORDINANCES (CONTINUED) 6. 7. RESOLUTIONS: RESOLUTIONS 1. Directing the Issuance of Various Raffle Licenses. Please note that the above Resolution will be put on hold until the next meeting, April24, 2008. 2. SUppOlt of Futme NJ DCA Neighborhood Preservation Funding. 3. Amendment to 2008 Temporary Budget. Borough Attorney Robert Bergen said the Temporary Budget, as you know you have cash operating before your budget is adopted. You have to do it at four (4) month intervals so you do 25% of the budget. It allows you to continue on, it's not increasing your budget. DISCUSSION Councilmember Naples asked if they got a specific number on the aid. Is that finalized? 3 APRIL 17, 2008 CONTINUED RESOLUTIONS RESOLUTION #08-105 "IN SUPPORT OF FUTl!JRE NJ DEPARTMENT OF COMMUNITY AFFAIRS NEIGHBORHOOD PRESERVATION FUNDING" RESOLUTION #08-106 "AUTHORIZING AMENDMENT TO THE 2008 TEMPORARY BUDGET" Borough Attorney Bergen replied that you should get one half of yom aid back; they will phase it in over two (2) or three (3) years you applied for discretionary aide so you probably won't hear until close to the time that the budget is adopted. Councilmember Naples said so nothing is really carved yet. BOl'ough Attorney Bergen said that the N.P.P. program we've all got notified that the State is cutting back on that. Instead of a five (5) year program we were getting $100,000.00 a year. They are cutting it back in 2009 so we'll have to do a resolution asking them to put money back in the budget. Resolutions #08-105 to #08-106 were introduced by the Council President Sitarz and referred to the Council for action. Upon MMS&C, by Councilmembers Naples and Bellino RESOLUTION #08-105 "IN SUPPORT OF FUTURE NJ DEPARTMENT OF COMMUNITY AFFAIRS NEIGHBORHOOD PRESERVATION FUNDING" RESOLUTION #08-106 "AUTHORIZING AMENDMENT TO THE 2008 TEMPORARY BUDGET" 4 were adopted. Upon individual roll call vote, Councilmembers Bellino, Colon, Naples and Sitarz voted in the affirmative. Councilmembers Diaz and Klllm were noted absent. The Municipal Clerk stated that there were no bills at this time. They will be at the next meeting. Council President Sitarz noted that at 6:03 P.M., Councilmember Diaz was noted present. BUSINESS TO BE ADDED: Councilmember Bellino said he just wanted (inaudible) since the opening of the Civic Center. There were some concerns over the usage of the field. The High School is using the field, which is not a problem. They took control of it and starting using Veterans Field which was basically built for baseball. They removed the mound and dragged it across the field and did not return it when they were done. We've had a meeting when we first built this three years ago to ensure that everything was done as far as Recreation was concerned. With Marty Murray, Tom Zanzaleri, softball and the Engineers. They made Mustillo Field the primary softball field. We also have the Utility Field. The point of this all is that they want to redo the field. It is not even a week old and they want to put circles and lines, they just dedicated it a week ago. My point is this; this is what the High School wants. They play nine (9) games, we play fom hundred (400) and it is his contention that we leave the fields as they are and if they don't like it they can play at Carteret Park where they have been playing for the APRIL 17, 2008 \<ERE ADOPTED ";\-!'MUNICIPAL CLERK STATED THERE \vERE NO BILLS - THEY IvILL BE ON FOR NEXT MEETING NOTED PRESENT AT 6:03 P.M. - Councilman Diaz BUSINESS TO BE ADDED DISCUSSION 5 APRIL 17, 2008 DISCUSSION CONTINUED past twenty-five (25) years. It is a situation where it is too nice to start messing a round with it and changing things. We have no issues with the Girls Softball League. We welcome the High School to play but they have to play on Mustillo Field and follow the schedule we give them and not dictate to us, that is the issues I'm concelTIed with. Council President Sitarz asked if the Mayor's office is aware of this. Councilmember Bellino replied yes. Councilmember Diaz asked if these two particular fields are the ones designated for (inaudible). Councilmember Bellino replied yes, hard ball, Veteran's, which is behind the club house; Mustillo which is in the middle and the primary one for softball and then Knights of Columbus which can go either way. Councilmember Diaz asked who is pushing to (inaudible). Councilmember Bellino replied that it was the High School demanding that they want what they want. Councilmember Diaz asked if they wanted Softball circles on Veterans Field. 6 Councilmember Bellino replied that they want us to redo the field which would cost us some money but because it is used for hardball you would have to reline the boxes a different color. The appearance of white circles in a white batters box with a background of yellow or another color to incur a softball parameter that just doesn't cut it at this point. We never had an issue before. Umpires know what the ten (10) foot lllles are and pretty much what is going on. So, it is a situation where it is just a visual but at the same point in time there is some issues and you'll be hearing more about it. is Councilmember Diaz asked if the Little League Organization. iinline in terms of what we're talking about. Councilmember Bellino said they are 100% behind what he is saying. He said he was in a meeting and we committed to a certain thing. I am not going to back out of what I committed to, it just will not happen. We committed to Baseball, Softball, Utility. I think that is a situation we all have to understand. I spoke to the Mayor about my commitments, he knows what it is. We have to cater to everybody. I have four hundred (400) children and twenty (20) kids with nine (9) games, they are welcome to play but by our lllles. We will be hearing more about this. Council President Sitarz said that was the way it was going to stand because we just spent a large sum of money on those fields and there's no need for us to go changing it around right now. Conncilmember Naples said there is a field available to fit their schedule, correct? Councilmember Bellino said they had a field available all the time, at any time. APRIL 17, 2008 DISCUSSION 7 APRIL 17, 2008 Councilmember Diaz said a concern is that portable mound. Councilmember Bellino said the mound was dragged across the field and dumped in a comer. One of these days someone is going to pick it up and walk away. Councilmember Diaz asked if that could be bolted down. Councilmember Bellino said he spoke to Mr. Kately after he spoke to the Mayor and we will be bolting that down. DISCUSSION Councilmember Diaz asked if that was the COITect mound that should have been ordered. Councilmember Bellino replied yes. The thing is that during the course of the years he has been involved in baseball in town for the past 35 years and we always had mounds on all the fields and the mounds were never moved. If it has to be moved, only we can to do it. Councilmember Diaz wanted to commend the Council President for running such an efficient meeting. He said he had one thing to add, they are looking at reconfiguring the departments to facilitate five depattments with the Council President serving as a member to all the committees. They've done some research in terms of the Municipalities and City's that have a Commission form of government that have five (5) Committees and are trying to use some of these as templates, not for the change in our government but for facilitating six (6) departments.. .how to group them. If you have any suggestions, I have been working on it and have a few ideas. If you have any suggestions on how we can split certain commit.tees or combine certain committees, please let me know as well. 8 April 17, 2008 Council President Sitarz noted that the Sheik's Parade is on Saturday Moming at the Flag Raising. Sunday is South Amboy's Saint Patrick's Day Parade. We are going to have a float. Everyone is invited to Mr. Dato's house after the parade. Borough Attomey Robel1 J. Bergen, Esq. said there was one Resolution he would like to add, at least a verbal resolution before the next meeting. As you know, the Mayor has entered into an inter-local agreement with the schools and he would like to authorize the Mayor to sign the agreement. Councilmember Naples asked if he was talking about the Shared Services Agreement. Attorney Bergen replied yes. Councilmember Bellino wanted to know what the requisites are and the list of what we're sharing. Borough Atlomey said they were going to paying them approximately $700,000.00 a year. The ball field parks brought it to his mind. We'll be supplying the garbage collection facilities and will be entering into a Community Safety Program that incorporates Safe Street Program. Council President Sitarz asked ifhe needed a resolution on that. Borough Attomey replied yes, He needs at least a Resolution authorizing the Mayor to sign it because since the school budget went out there may be some negotiations over the next week and you may want it signed. Sheik's Parade St, Patrick's Day Parade 9 APRIL 17, 2008 RESOLUTION #08-107 "SHARED SERVICES - BOARD OF EDUCATION" PUBLIC DISCUSSION ADJOURNED Councilmember Bellino said no just add it on and if it's not ready eliminate it. Upon MMS&C, by Councilmembers Bellino and Diaz and unanimous affirnlative vote of the four (4) members present, Resolution #08-107 was adopted. Upon individual roll call vote, Councilmembers Bellino, Colon, Diaz, Naples and Sitarz voted in the affirmative. Councilmember Krun1 was noted absent. RESOLUTION #08-107 "SHARED SERVICES - BOARD OF EDUCATION" PUBLIC DISCUSSION There was none at this time. ADJOURNED At approximately 6:15P.M., after no further discussion, this meeting was adjoumed upon MMS&C, by Councilmembers Bellino and Diaz and unanimous affirmative vote ofthe five (5) members present.
