O / /.3 RESOLUTION GRANTING A VARIANCE FOR DEMETRE NICOLOFF AND ARDELLE NICOLOFF WHEREAS, Demetre Nicoloff and Ardelle Nicoloff (Applicants) have requested a variance to reduce the required setback from the lakeshore to 170 feet for their home at 1492 Hunter Drive; and WHEREAS, Section 826.25 of the City's zoning ordinance requires that residential structures which exceed 30 feet in height maintain setbacks which are double those otherwise required, resulting in a required setback from the lakeshore of 200 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat., Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission and City Council have considered the Applicants' request and have reviewed the matter thoroughly. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance be granted because the shape of the lot and drainage in the area constitute hardships to the property which justify the requested variance.
