HomeMy Public PortalAbout1987-132Member IXi f!) introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. -4.Jo2- RESOLUTION GRANTING A VARIANCE FOR FRED FAXVOG AND JULIE FAXVOG WHEREAS, Fred Faxvog and Julie Faxvog (Applicants) have requested a variance to build a house at 1220 Oakview Road which will be 34 feet in height on a lot which is 2.15 acres in size and to locate the house 40 feet from the rear lot line; and WHEREAS, Section 826.25 of the City's zoning ordinance requires that residential structures exceeding 30 feet in height be located on lots at least 3.5 acres in area and that all setbacks be doubled, resulting in a required rear yard setback of 80 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinance and Minn. Stat., Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstance unique to the property; and WHEREAS, the planning commission and City Council have considered the Applicants' request and have reviewed the matter thoroughly. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the described variance be granted because the existence of the following hardships relating to the property justify the variance: 1. The configuration of the lot; 2. The heavily wooded character of the property; 3. The fact that 89 percent of the perimeter of the house is less than 30 feet in height; and 4. The fact that all second story rooms will be accessible with fire fih-eernb.t.r hting equipment. Dated:1987.
