A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA TO AUTHORIZE THE WAIVER OF
CODE ENFORCEMENT LIENS AND CITATIONS ON 2060
LINCOLN AVENUE, 2070 LINCOLN AVENUE AND 15050
DUVAL STREET IN THE OUTSTANDING AMOUNT OF
$42,158.06; PROVIDING FOR RECITALS; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City of Opa-locka has the option to waive the outstanding amount of Code
Enforcement liens and citations of properties within the City; and
WHEREAS,the waiver will reduce the account receivable balance,but will enhance the tax base
of the City of Opa-locka by allowing for redevelopment of these properties; and
WHEREAS, the City Commission hereby waives the outstanding Code Enforcement liens and
citations of the properties known as 2060 Lincoln Avenue, 2070 Lincoln Avenue and 15050 Duval
Street:
NOW,THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA,FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka, hereby authorizes the waiver of
the outstanding Code Enforcement liens an citations on the properties located at 2060 Lincoln Avenue,
2070 Lincoln Avenue and 15050 Duval Street,in the outstanding amount of$42,158.06. Water and
Sewer liens on these properties are not waived, and shall remain in force.
Resolution No. 10-8083
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED THIS 9th day of June,2010.

Request: Approval to waive $42, 158.06 in Code Enforcement Liens
Description: The City management has been approached to consider waiving certain code enforcement
liens and citations on 2060 and 2070 Lincoln Avenue and 15050 Duval Street. Staff
researched the request and noted that there are 2 types of liens outstanding on these
properties ie: Water/ Sewer liens of $20,663.27 and Code enforcement liens of
$42,158.06. Statutorily the water/sewer liens of 20,663.27 cannot be waived; and will be
required to be paid.The commission has the option to waive code enforcement fines and
citations at their discretion.
Financial Impact: This action will reduce the account receivables balance but will enhance the tax base
of the city.
Implementation Timeline: Immediately
Legislative History: None
Recommendation(s): Staff recommends approval.
Analysis: These liens have been outstanding since 2007 through 2009.
