HomeMy Public PortalAbout1988-007Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO MARTY SCHNEIDER WHEREAS, Marty Schneider (Applicant) has applied for a conditional use permit to allow construction of a 40' X 24' accessory building on his property at 1235 Hunter Drive, which structure would bring the total area in accessory structures on his property to over 3,000 square feet; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on January 12, 1988, and by the City Council on February 2, 1988; and WHEREAS, it has been determined that the existence of the proposed accessory structure will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. There shall be no animals housed in the new accessory building; 2. The exterior of the new accessory building must be constructed of the same materials as the principal structure; 3. The existing 13' X 16' shed shall be removed by the Applicant within 30 days of the date of completion of the new accessory building; 4. It is agreed and understood that the Applicant acquires no vested rights in the existing barn by means of this conditional use permit and that if the building is destroyed, it cannot necessarily be reconstructed to the same size; 5. It is further agreed and understood that the location of the existing barn is 145' from the lot line rather than the 150' required by ordinance and that should the barn be destroyed it would need to comply with all applicable setback requirements; and 6. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
