SUPPORTING SENATE BILL S-1608
WHEREAS, Senate Bill S-1608, reIeased by the Senate Committee as a Substitute, 2"'
Reading without recommendation, amending R.S.33:1-12, removes two plenary retail
distribution license limit for certain food stores and liquor stores in which this bill would
-'Pennit mare than two licenses and to sell liquor in addition to the beer and wine
permitted under the current bill; and
WHEREAS,a, such, S-1608, defines a supermarket as a bona fide food stote of no less
than 30,000 square feet in size in whicli the retail sale of groceries or either foodstuffs is
the primary and principal business, and at which the .sale of alcoholic beverages is
incidental, but prohibits the acquisition "of an additional plenary retail distribution license
or licenses in connection with a supermarket located in an"urban enterprise zone; aqd
'VHEREAS, 8-1608, prohibits certain retail mercantile establishments that are referred
to as "big box stores" for acquiring 'beneficial ip.terest in plenary retail distribution
license; and
'VHEREAS, as such, under the provisions of S-1608, these are stores at which the retail
sale of groceries or other foodstuff is not the primary and principal business and that are
greater than 100,000 square feet of gross buildable area at full build-out; and
WHEREAS, 8-1608 would enable a license that operates a supermarket to purchase
already existing plenary retail distribution licenses and the bill will not create a new type
of distribution license; and .
WHERE;AS, the New Jersey League of Municipalities strongly supports 8-1608 as
rele~sed l:J-hd has requested that all of its members to go on record similarly supporting the
same. I ,."
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Borough of Carteret.hereby supports Senate Bill 8-1608 released
by the Senate Committee as a' Substihlte, 2nd Reading without
recommendation.

2. That a copy of this Resolution be forwarded to the New Jersey League of
Municipalities. -..
