RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
RMT, INC. AND RONALD SPLE.TT,
MICHAEL LARSON AND TERRY LINGEN
DBA INN KAHOOTS
WHEREAS, RMT, Inc. and Ronald Splett, Michael Larson and Terry Lingen,
dba Inn Kahoots (Applicants) has applied for a conditional use permit for a
bar and limited food service business at 45 Hamel Road; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on
January 12, 1988, and February 9, 1988, and by the City Council on March 1,
1988; and
WHEREAS, it has been determined that the existence of the Applicants'
business will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicants for the
stated purpose, subject to the following terms and conditions:
1. There shall be no exterior storage on the property;
2. The exterior signage on the property shall remain unchanged;
3. The parking area shall be blacktopped to city standards by June 30,
1990;
4. The Applicants shall screen the exterior trash container in a manner
acceptable to city staff;
5. The Applicants shall blacktop the loading area to a 9-ton capacity;
6. The Applicants shall install landscaping meeting city requirements
and satisfactory to City staff no later than June 30, 1990;
7. Hours of operation shall be limited to 9 a.m. to 1 a.m., Monday
through Saturday and noon to midnight on Sunday;
8. The number of employees shall be limited to six part-time and two
full-time;
9. The Applicants shall ensure that any exterior lighting is designed so
as not to broadcast light onto adjacent properties;
10. Site drainage shall be accomplished in accordance with City
requirements and satisfactory to city staff;
11. The Applicants shall remove the existing exterior loudspeakers.
Temporary loudspeakers may be used only in conjunction with the
rodeo held once annually on the site;
12. The Applicants shall be permitted to hold one special event annually
at the site and shall give the City adequate prior notice of the
time and nature of the event;
13. The Applicants shall pay the SAC unit charges determined by staff to
be due for the site;
14. The Applicants shall apply for a building permit within 30 days of
the date of city council approval of this conditional use permit;
15. Prior to issuance of the building permit by the City, the Applicants
shall pay a connection charge in the amount of $6,156.27;
16. The Applicants shall submit to the City a letter of credit in the
amount of $34,275 to ensure completion of the required site work;
17. The Applicants shall comply with all plans and drawings submitted to
the City and upon which City review has been conducted; and
18. The Applicants shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
