MATOS T/A GIO'S RIVERSIDE BAR WHEREAS, on Jupe 19, 2008; the ~ayor and Council of the Bor9ugh 'of Carteret sitting as the local Alcoholic Beverage Control Enforcement Authority issued a NO.TICE OF HEARING ON CHARGES AND VIOLATIONS against Plenary Retail Consumption License #1201-33-003-0'03 Sergio M. Matos, t1a Gio's Riverside Bar, a copy is attached hereto and made a part hereof; and WHEREAS, prior to the scheduled ABC Hearing, this matter has been resolved as follows: 1. That the above referenced license desires to enter into a plea of guilty to the charges as presented in the NOTICE OF HEARING, ON CHARGES AND VIOLATIONS. 2. That the above referenced Licensee's Plenary Retail Consumption License #1201-33-003-003 is hereby suspended for a tenfl of three (3) days to be served on the next three (3) consecutive Tuesday's, August 12, 19 and 26, 2008. 3. Sergio Matos t/a Gio's Riverside Bar Liquor License No.: 1201-33-003-003 Dear Mr. Matos: This letter will confirm our tclephone conversation wherein you advised your desire to plead guilty to the two (2) charges brought against you with regard to the above-referenced liquor license. As you are aware the above-referenced matter was scheduled to be hcard by the Borough of Carteret's Alcohol Beverage Control Board, and that hearing had been scheduled for Thursday evening. August 7,2008. By virtue of this resolution and your desire to plead guilty to the charges, the hearing has become unnecessary. This letter will confirm that the matter has been resolved in the following manner: 1. As the above-referenced licensee, you agree to plead guilty to a charge of selling or serving alcoholic beverages past lawful business hours, as well as having non- employees on the premises after legal hours on or about March 18, 2008; 2. Your decision in this regard is knowing, intelligent and voluntary; 3. You agree your establishment will be closed to the public on three (3) consecutive Tuesdays in 2008 (8/12, 8/19 and 8/26); 4. You agree to display a sign, which indicates that your closure is "By Order of the Borough of the Carteret Alcohol Beverage Control Board" and that this sign shall be displayed on each of the days upon which you are closed. This sign shall be 3 feet by 3 feet, and prominently displayed on the front door. The sign may be purchased at any local sign shop that you choose; 5. The Borough of Carteret Alcohol Beverage Control Board shall prepare and cause to be file a resolution memorializing these understandings.
