J D - 4;2- RESOLUTION GRANTING PRELIMINARY APPROVAL OF A SUBDIVISION FOR FIDEL ECKES WHEREAS, Fidel Eckes (Applicant) has requested approval of a plan to subdivide his property located at T.H. 55 and Arrowhead Drive according to the preliminary plat attached hereto as Exhibit A; and WHEREAS, the planning commission and city council have reviewed the preliminary plat submitted by the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is granted to the Applicant for his plat, subject to the following conditions: 1. Outlot A shall be used as an access easement for the three properties east of the Applicant's parcel; 2. Outlot B shall not be developed until sewer and water are available to the site because it does not have adequate soils for on -site sewage disposal; 3. The final plat shall show drainage and utility easements as required by the city engineer; 4. It is acknowledged by the Applicant that proposed lots 1 through 3 shall be used solely for single family residential purposes; 5. The Applicant shall dedicate the right-of-way for T.H. 55 and Arrowhead Drive required by the city engineer on the final plat; 6. The 30' wide strip of land located in the northeastern portion of the property shall be combined with the adjacent lot or otherwise disposed of in a manner satisfactory to city staff; 7. No park dedication fees shall be required because each of the lots is at least 10 acres in size; 8. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing the subdivision; 9. The Applicant shall submit a current abstract of title or registered property abstract covering all land within the subdivision for review by the city attorney; and 10. The Applicant shall submit the final plat to the city for approval within 180 days of the date of the adoption of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it shall incorporate all changes and modifications required by this resolution.
