RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
KENNETH DOBOZENSKI AND PHYLLIS DOBOZENSKI
DBA DANNY'S CATERING
WHEREAS, Kenneth Dobozenski and Phyllis Dobozenski, dba Danny's Catering
(Applicants) have applied for a conditional use permit for a bakery,
restaurant and catering business at T.H. 55 and Co. Rd. 19; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on
December 8, 1987, and January 12, 1988, and by the City Council on March 1,
1988; and
WHEREAS, it has been determined that the proposed business operation will
not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicants for the
stated purpose, subject to the following terms and conditions:
1. There shall be no exterior storage on the site;
2. The exterior building materials of the existing

the plan submitted to the City;
7. Hardsurface coverage shall not exceed the 60/40 ratio as shown on
the plan submitted for the City;
8. Hours of operation shall not exceed 3 a.m. to noon daily;
9. The number of employees shall be limited to six;
10. Exterior lighting shall be installed in accordance with the plans
submitted to the City and shall be designed so as not to broadcast
light off of the site;
11. The addition to be built at the southwest corner of the existing
building shall be of block construction and shall not exceed 12' x
60';
12. The on -site septic system and drainfield shall be subject to
approval by city staff;
13. A11 food handling operations shall be approved and licensed by
Hennepin county;
14. The Applicants shall remove the sign at the southeast corner of the
property by June 1, 1988;
15. The Applicants shall remove the propane tank on the southern portion
of the property by June 1, 1988;
16. The Applicants shall utilize grease traps in the kitchen and low
water use toilets as required by city staff;
17. The Applicants shall screen any roof top mechanical equipment to the
satisfaction of city staff;
18. There shall be no overnight parking of vehicles on site;
19. The existing shed must meet city setback requirements from the
principal building and all property lines;
20. The Applicants shall comply with all plans and drawings submitted to
the City and upon which City review has been conducted; and
21. The Applicants shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
