PROFESSIONAL SERVICE CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to provide engineering
and services during the construction phase of the Cooke Avenue Sewer
Rehabilitation and Pershing Avenue Sewer Separation;
WHEREAS, cngineering services arc a professional service exempt from the
requirement of public bidding pursuant to N.J.S.A. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officer has certificd that funds are available..
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve thc appointment of Killam Associates at
a maximum cost not to exceed $12,400.00 billable per attached contract.
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on April 29, 2000.
Adopted this 24th day of April, 2000
and certified as a true copy of the original
on April 25, 2000.

As per Resolution Number 00-137.
THE CONTRACTOR does hereby agree to perform the following
PROFESSIONAL SERVICE CONTRACT TO PROVIDE ENGINEERING AND
SERVICES DURING THE CONSTRUCTION PHASE OF THE COOKE AVE.
SEWER REHABILITATION AND PERSHING AVE., SEWER SEPARATION.
THE INDEMNIFICATION AGREEMENT
NOT TO EXCEED $12,400.00
According to the terms set forth in Resolution.
ON THE REVERSE OF THE PURCHASE
ORDER SHALL BE LIMITED TO TEE
VENDOR'S NEGLIGENT OR WRONGFUL
ACTS.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
IN WITNESS WHEREOF, the parties hereto havc hereunder set their hands and seals or
caused these presents to be siged by their proper corporate officers and their corporate
seals to be hereto affixed, the day and year written above.
