RESOLUTION NO. S1.-
RESOLUTION GRANTING AN AMENDED
CONDITIONAL USE PERMIT TO
BRUCE NEUMANN
WHEREAS, on March 4, 1986, the City of Medina granted a conditional use
permit to Bruce Neumann (Applicant) to operate a repair garage on property
located at 25 Hamel Road and legally described as Lot 1, Hamel Legion Park,
Hennepin County, Minnesota; and
WHEREAS, the Applicant has applied for an amendment to his conditional
use permit to allow construction of a 27' x 34' addition to the western end of
his existing garage; and
WHEREAS, the City's zoning ordinance requires an amended conditional use
permit under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission most
recently on February 9, 1988, and by the City Council on March 1, 1988; and
WHEREAS, it has been determined that the existence of the addition to the
garage will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that an amended conditional use permit be granted to the Applicant
for,ih-e stated purpose, subject to the following terms and conditions:
1. The exterior of the garage shall be brought into compliance with the
City's performance standards by September 1, 1988;
2. The trash containers on the site shall be screened from view from
adjacent properties and roadways;
3. Exterior lighting on the site shall remain unchanged;
4. Completion of the addition to the west of the garage shall be
coordinated with removal of the addition to the south and shall be
monitored by city staff;
5. The repair garage shall be screened from public view by the fence
in place on the property and by the landscaping planted by the
Applicant as required by the conditional use permit granted on March
4, 1986. The fence and landscaping materials shall be maintained in
good condition throughout the duration of this conditional use
permit;
6. The hours of operation of the repair garage shall not exceed 6:00
a.m. to 10:00 p.m. daily;
7. The city council may review the condition of the property on or
after March 4, 1991, and may require that the driveway be
blacktopped;
8. Storage of flammable liquids on the property shall be done in
compliance with all state and city codes; and
9. The Applicant shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Medina that variances be granted to the Applicant to reduce the required side
and rear yard setbacks to 15' for the garage addition on the grounds that such
setbacks would be consistent with those of the existing structure.
