O O - / / RESOLUTION ADOPTING AMENDED ASSESSMENT ROLL FOR IMPROVEMENT OF WILLOW DRIVE NORTH OF T.H. 55 WHEREAS, pursuant to resolution no. 87-100, adopted on September 15, 1987, the City Council adopted an assessment roll for the improvement of Willow Drive north of T.H. 55; and WHEREAS, Wallace H. Cates and Jeffrey S. Cates, owners of property against which an assessment was then levied, appealed their assessment to Hennepin county district court; and WHEREAS, the City and the appellants have reached an agreement regarding the amount to be assessed against appellant's property and have entered into a Stipulation for Dismissal regarding the matter. NOW, THEREFORE, Be It Resolved by the City Council of the City of Medina, Minnesota as follows: 1. An amended assessment in the principal amount of $6,000 against parcel no. 04-118-23-11-0001 is hereby adopted and shall constitute the special assessment against the land. The land is hereby found to be benefited by the improvement in the amount of the assessment levied against it. 2. The assessment shall be payable in equal annual installments extending over a period of 8 years, the first of the installments to be payable in 1988, and shall bear interest at the rate of 9 percent per annum. To the first installment shall be added 15 months' interest. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of the property so assessed may, at any time prior to certifi- cation of the amended assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city clerk -treasurer. The owner may, at any time thereafter, pay to the city clerk -treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of of the next succeeding year. 4. The city clerk -treasurer shall forthwith transmit a certified duplicate of this amended assessment to the county auditor to be extended on the property tax lists of the county, and such assessment shall be collected and paid in the same manner as other municipal taxes. The city clerk - treasurer shall take all action necessary to have the 1988 tax statement previously issued changed to reflect the amended assessment. 5. Nothing contained herein shall affect in any manner the assessment levied against parcel no. 04-118-23-13-0003 pursuant to resolution no. 85-110. Dated:Q , 1988.
