Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 3 1- RESOLUTION REGARDING ACCEPTANCE OF WATER TREATMENT FACILITY RESIDUE AT WOODLAKE SANITARY LANDFILL WHEREAS, Woodlake Sanitary Service, Inc. (Woodlake) operates a sanitary landfill for mixed municipal solid waste (Landfill) within the City of Medina under the terms of a conditional use permit (CUP); and WHEREAS, Woodlake has requested permission to accept residue from the City of Bloomington's water treatment facility at the Landfill; and WHEREAS, the residue may not be placed in the Landfill without specific approval by the city council because the residue is not mixed municipal solid waste within the meaning of Minn. Stat., Section 115A.03, subd. 21; and WHEREAS, the residue had previously been placed in Flying Cloud landfill in Eden Prairie but can no longer be sent there due to the temporary closure of that landfill; and WHEREAS, the City of Bloomington is able to retain only small quantities of the residue on site due to very limited storage available at its water treatment facility; and WHEREAS, the residue has been tested by the Minnesota pollution control agency and deemed to present no environmental threat which would prevent its placement in sanitary landfills; and WHEREAS, the city council has reviewed the environmental risks posed by acceptance of the residue and is aware of the urgency of Bloomington's need to dispose of the material following the abrupt closure of its primary disposal facility. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that Woodlake is hereby granted approval to accept water treatment facility residue at the Landfill, subject to the following conditions: 1. Residue may be accepted only from the City of Bloomington's water treat- ment facility; 2. Permission to accept the residue at the Landfill is valid only through September 1, 1988, or upon opening of Bloomington's on -site storage facility, whichever occurs first; 3. The City retains the right to amend or revoke permission to accept residue if the chemical nature of the residue is altered or if evidence exists of environmental hazards posed by placement of the residue in the Landfill; 4. Woodlake shall not accept residue on Sundays and shall in all other respects comply with the terms and conditions of the CUP with regard to handling wastes accepted at the Landfill, including the payment of fees authorized by the CUP and Minn. Stat., Section 115A.921; and 5. Nothing contained herein shall be construed to alter or amend any provision of the CUP. Dated:, / , 1988.
