City Manager Koski presented background information, stating the City
Council, at their regular meeting held December 4, 1979, continued
public hearing relating to the change in assessments° The City has
received protest from all six property owners involved.
Mayor Dennis declared the continued public hearing open and invited
anyone wishing to speak to come forward. No one came forward
Councilman Atkins moved to close public hearing, seconded by Councilman
Merritt and carried,
Councilman Atkins moved to adopt Resolution No. 80 -1870 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CIfiY "ABANDONING PROCEEDINGS
FOR TEMPLE CITY IMPROVEMENT NO, 79 -6, seconded by Councilman Merritt
and carried.
City Attorney Martin advised that terminating proceedings means that
there are no further actions pending before the City Council relating
to subject improvement.

7o PUBLIC HEARING: APPEAL FROM PLANNING COMMISSION DENIAL - ZONE
VARIANCE NO. 79 -569, 5048 SERENO DRIVE
City Manager Koski presented background information, stating the
Planning Commission, at their regular meeting held November 27, 1979,
held public hearing and adopted a resolution denying a zone variance,
conditional use permit and tentative tract, The tentative tract
application was received by the City prior to the moratorium on
condominium construction; applicant applied for and received relief
from the moratorium and case was considered by the Planning Commission
November 13, 1979, but because of the new provisions imposed by
Ordinance No, 79 -486, the tract could not be approved and applicant
was instructed to apply for a zone variance and a conditional use permit,
a regulation imposed by the ordinance. The application is for a 6 -unit

condominium - project, one unit to be a one -story structure and five
units .two- story structures which requires a 100 ft. street frontage.
The subject property has a 70 ft. street frontage. The proposed units
are in compliance with the current R -2 development standards and
consistent with the General. Plano On December 3 1979, within the
prescribed time for . filing an appeal, applicant submitted an appeal
to. the Planning Commission denial, and City Council, at their regular
meeting held December 4, set public hearing for January 15, 1980.
Mayor Dennis declared the public hearing open and invited anyone
Iwishing to speak to come forward.
Councilman Atkins moved to include the Planning Couuission minutes
as .a part of the record, ..seconded by Councilman Gillanders and
carried,
Mr James. Nelson, 408 S. Rosemead Boulevard, Pasadena, representing
the applicant, .. stated that although the Planning Commission voted
3 -2 to deny the variance, he felt that body favored the variance
but that :. it was their desire the-City : Council •should be the body to
grant .the .variance. It was his contention the property is unique,
and presented a map of the block which shows the lot has the largest
- .total: area of any lot in the area; none of the lots have more than
55 ft. street frontage; the depth of the property' allows for a large
yard area for.each of the units proposed and still maintain all
criteria for. development Mr. Nelson, by means of a plot plan using
the property .next to subject parcel, _ and using a .mirror concept,
demonstrated that .twice as many units could be legally developed,
with all criteria being met, thereby making the proposed development
reasonable. He further stated the applicants would be willing to
provide double pane windows,, especially on the easterly side of the
structures as a method of soundproofing.
Mr. Joseph Waterman, 4943 Encinita Avenue, owner/operator of kennels,
stated the property in .question backs up to M-1 zoned property from
Iwhic h, a: great deal-of noise is generated, including Community Disposal.
There would be no buffer for the second story units, and he would like
some consideration given that fact, to eliminate any future problems.
Mr. Raymond Peterson, 5066 Sereno, stated he gets noise from the
kennels and he feels there could be future problems from occupants
of the two-story units complaining - about the noise. He also expressed
concern with the possibility of an additional number of children
playing in the streets, _ as..:in. his _ opinion there is a large amount of
traffic. Mr. Peterson also stated their supply of water in the summer
months is nil and inquired about the ability to serve six additional
units:.:..
In answer to question from Mayor .Dennis, Planning Director Dragicevich
advised one of the conditions of the tentative tract map would be
water mains of sufficient size to accommodate the total domestic,
and fire flows required for the land division,
Mr, John Bionca, 5007 Encinita, agreed with Mr. Peters'on that there
is a strong possibility that new residents will complain about the
noise emanating from the kennels.
In rebuttal, Mr. Nelson stated ..two -story structures are not unique
to the 'street and if necessary, the applicant will fully soundproof
everyone of the units to protect the kennel operators from future
complaints.; and that the .water line will be improved in order to
meet the requirements for water flow.
There being no one else come forward, Councilman Gillanders moved
to close public hearing, seconded by Councilman. Atkins and carried,
Councilman Atkins moved to make the Planning Commission minutes a..
part of the record, seconded by Councilman Gillanders and carried,

Councilman Atkins moved to certify an Environmental Impact Report
was prepared and filed .pursuant :'to the California Environmental
Quality Act:. of 1970., as amended; that, the report be amended to
include the .comments of those ,testifying at the public hearing by
incorporating .:a:. copy .of the minutes into the report; that the City
Council:.has; reviewed . :and ..:considered the information contained in
the report; and that each ;. and every adverse environmental impact
contained 'in. :the amended:_ report is overruled and counterbalanced
by economic and social needs, objectives, and concerns in providing
private or public improvements of municipal import, seconded by
Councilman Gillanders and carried.
Councilman Atkins stated the applicant has worked hard to come.
up with a viable project and he feels because of the great depth
of the lot; a reasonable use could not be accomplished without a
variance and he would support the variance,
Councilman Gillanders stated the property is unique by virtue of
its dimens ions; the project is well thought out and the developer
has. camplied with the .spirit of the new ordinance. Because of the
tendency of people to complain about excessive noise, he feels
there should :.b.e: some soundproofing of the structures and he would
support: the project.
Councilman Merritt felt this is a classic example for the use of
the variance procedures; the project is well done and he would
approve the variance
Councilman Tyrell felt the proposed project is reasonable and
moved to grant the appeal:, subject to soundproofing the upper
stories ,of. the structures, seconded by Councilman Atkins and carried
City. Attorney Martin advised the motion was addressed to the appeal
for variance and the Council could now act on the conditional use
permit and tentative tract map, or send the matter back to the Plan -,
ning..Commission.: f

Tyrell moved to adopt, seconded by Councilman Atkins and carried.
Mayor Dennis stated this project indicates what he was trying to
point. out in the .discussion relating to the condominium ordinance,
that there is no need for 100 ft, street frontage to get a good

8 PUBLIC. HEARING APPEAL FROM PLANNING COMMISSION DENIAL ZONE
VARIAN -CE NO 79 -568, 4805 HALLOWELL AVENUE
City Manager Koski presented background information stating the
Planning Commission, at their regular meeting held November 27, 1979,
held public hearing and adopted. Resolution No. 79 -873PC denying a
zone variance .to:allow an addition to the existing single family
residential building which would: add to an existing non - conforming
use located in a C -2 General- Commercial zone on the basis the request
does.not meet the .requirements :for granting a variance, the proposed
addition is contrary to the General Plan and to grant a variance
would expand a legal, nonconforming use. The applicant submitted
an :.appear. on December 3, 1979 within the prescribed time for filing
an appeal, and City Council, at their regular meeting held December 4
set public hearing January 15, 1980.

Mayor Dennis declared the public hearing open and invited anyone
wishing to speak.- to come forward'. Councilman Merritt moved to
include the Planning Commission minutes as a part of the record,
seconded by Councilman Gillanders and carried.
Mr. Carl Rasmussen, 4805 Hallowell, stated 18 years ago he tried
to get a bus.ine.ss -license- and-was refused; that now he is retired
and wishes to live there and is requesting to add a room for
recreation and that has been denied.
I.:There..b.eing no-one else ..come-forward-to speak, Councilman Merritt
•moved..to close the public hearing, seconded by. Councilman Gillanders
and carried.
Councilman Merritt stated he does not see a problem in adding to
the residential property and he would favor the appeal.
Councilman Tyrehl and. Councilman Gillanders agreed, stating the
addition would be an advantage to the owner and would not deter
from its being used as a commercial property in later years.
Councilman_Atkns stated. the Planning Commission arrived at what
they felt, was the right decision; however, this is a slight change
which would provide the owner the enjoyment of his property and
he would approve a variance.
Councilman Gillanders moved to grant the appeal and adopt Resolution
No 80- 1859 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CiTY REVERSING RESOLUTION NO. 79 -873PC AND GRANTING A VARIANCE
(ZV.79 568) subject to the five conditions recommended by the Plan-
ning staff and the additional condition the commercial' sign be
removed, seconded by Councilman Merritt and carried
9e PUBLIC HEARING: TENTATIVE TRACT NO. 35584, 6351 N. TEMPLE CITY
BOULEVARD.
ICity Manager Koski presented background information stating the
Planning Commission, at°. their _ regular meeting; held December 11,
1979 adopted Resolution No 79 -874PC approving Conditional Use
Permit Case No 79 -571 and recommending approval of Tentative Tract,
No 35584 for six unit condominium project in an R -2 zone° The
proposed development is consistent with the General Plan, Proposed
are two 3-bedroom and four 2- bedroom units, each having a 2 -car
garage and one open parking space. A 6 ft, high perimeter wall will
be constructed except in the required front yard area. The Planning
Commission certified a draft Environmental Impact Report. City
Council, at their regular meeting held December 18, 1979, set public
hearing for January 15, 1980.
Mayor Dennis, declared the public ,hearing open and invited anyone
wishing to speak to come forward, Councilman Atkins moved to include
the Planning Commission minutes a part of the record, seconded by
Councilman Merritt and carried.
Luis Arias, J. H. Hedrick & Company, 900 S. San Gabriel Boulevard,
stated he was available to answer any questions the Council might
have
There being no one else come forward to speak', Councilman Atkins
moved to close the public hearing, seconded by Councilman- GilIanders
and carried.

was prepared and filed pursuant to the California Environmental
Quality' Act of-1970, as_ amended; that the City Council has reviewed
and considered the information contained in the report; and that
each and every adverse environmental impact contained in the report
is overruled and counterbalanced by economic and social needs,
objectives, and concerns in providing private or public improvements
of municipal import, seconded by Councilman Gillanders and. carried,

PUBLIC HEARING: TENTATIVE TRACT NO. 37582, 4503 -15 ELLIS LANE
City Manager Koski presented background information stating the
Planning Conuiuission,.at their regular meeting held December 11, 1979,
adopted Resolution No. 79 -875PC and approved Conditional Use Permit.
Case No. 79-572, recommending approval of Tentative Tract No. 37582
to construct a.13 -unit condominium project in an R -4 zone. The,
proposed development is consistent with the General Plan; each unit
will have :a two -car garage and a patio, and there will be nine open
parking spaces. sp aces The Planning Commission certified a Draft Environ -
mental.Impact Report and. City Council, at their regular meeting of
December 18, 1979, set public hearing January 15, 1980.

11 PUBLIC HEARING:- BALDWIN AVENUE IMPROVEMENT PROJECT
City Manager Koski presented background information, stating the
City-Council, at their: regular-meeting held August 21, 1979, approved
an agreement between the -City and the County to improve Baldwin
Avenue from- Live.Oak -- Avenue to Lower Azusa. Road. The improvements
include-the-installation of-water- carrying gutters, catch basins,
the resurfacing of the street, and the emplacement of patterned
concrete in:the median noses -Also being proposed is the removal
of four :trees .between :Duffy .Street and Bogue Street, and replace -
ment of:`sidewalk. Estimated cost for the project is $400,000.
Temple .City has an accumulated total of approximately $518,000 in
Federal Aid Urban: funds.. ,Project has been noticed for a public
hearing .and the residents in the area affected have been notified.
Councilman Atkins.: inquired about plans to correct the grading of
the north bound lanes at the south end of the City limits (north
of. Lower: Azusa Road) and was advised the plans do not call for
redesigning of the street, however, the material being planned,
Petro -Mat, is applied in such a way that the grading should be
corrected.

Councilman _Tyrell inquired whether the City can provide any guide-
lines to hold the contractor to some standard of performance so
that the problem can be corrected. City Attorney.Martinadvised
the Standard Specifications for Public Works provides standards.. of
performance and , the ` City Manager . would be the final judge of the
work performed, The specifications can be amended to write in the
fact the street is not now level and must be corrected.
Mayor Dennis.: declare.d the public hearing open and invited anyone
wishing to speak; to come forward.
IVirgil ::Jacobsen; 4922. Baldwin .Avenue, ..stated that the street is
caved'. in between 4922 - 4930;.; that after a. heavy rain the area sags.
Mr. Jacobsen also complained .that Angel's Feed, located on Baldwin .
in the. City of E.1 Monte, travels Baldwin Avenue and drops straw
to :::the: :s.treeto
Russell Gilman, 5241 Village. Circle, inquired whether there would be
an.: assessment .fo.r matching: funds to the federal aid funds and also
pointed .out 'some pot holes between the median islands. Mr. Gilman
was advised there would be no cost to the City or the residents for
the improvement "Project.
;.:Councilman. Tyrell_ : requested to contact the utility companies
to ascertain that they would have no plans for improvements after
the work is completed, which would necessitate their excavating in .
that area.

close the public hearing seconded by Councilman Gillanders and
carried.
Assistant ':.City Manager Pucci advised the City Council would need
to approve the plans and specifications in order to obtain the,
FAU funds next fiscal Year, however, some minor corrections: could
Itake • place:. during .the `project, but not redesigning of the street.
Councilman Atkins moved to approve plans and specifications for
the .Baldwin Avenue ..project and instruct staff to negotiate with
a .p.rivat.e, engineering .firm to : review the plans .. and specifications
for the purpose: of providing 'independent opinion as -to the adequacy
of the work proposed, seconded by CouncilmanGillanders. and carried.

Frank Bucaccio,6345.Temple City Boulevard, stated he has a beautiful
Oak ,tree .in... his ..front yard and approximately four days before the
,new year a large .limb - :was .:cut _off .on the street side ruining the
pruning job he had recently had done. It was not known whether the
tree ::trimmers : were private or. the City crew.
Elmer Black, ;. 9519. Las Tunas Drive, stated he is not familiar with
the.: procedures relating to the Consent Calendar, and inquired what
action:_ the Council had taken.on'Item E(1). Mr. Black was advised
a public hearing. was set February '5 to consider amendment to the
Zoning Code relating to minimum street frontage in all residential
zones.

meeting held December 18, 1979; approved proposed addition to Sears
Service Center on Rosemead Boulevard•, approved one free - standing sign
and the wall sgn•on Tiffany's Restaurant at 8925 Las Tunas Drive; and
approved a-mobile • conservation display by Southern California Gas
Company in the parking lot at Builder's Emporium through January 21, 1980.

15. MATTERS FROM CITY OFFICIALS:
A. Request to Attend League City Managers' Spring Conference,
San Diego, February 6 -8, 1980
Councilman: Atkins moved to authorize City Manager's attendance at
the 1930 Spring Meeting of City Managers to be held in San Diego,
February 6 -8, 1980, and approve attendant expenses, seconded by
Councilman Gillanders and carried.
B_ Controlled Access Fencing for Tennis Courts - Live Oak Park
City Manager presented information requested by Council at their
regular meeting held December 4, 1979, relating to additional
fencing for the tennis courts at Live Oak Park, Councilman Tyrell
advised there is damage to the tennis courts from bicycles and
skateboards and it is impossible for the park supervisors to
control the problem.
Councilman Atkins moved to approve the additional fencing for
the tennis courts at Live Oak Park as set forth in staff memo
dated;. December 11,1979, seconded by Councilman Tyrell and
carried on a roll call vote:

Councilman Atkins moved to approve subject to the required Certi-
ficate of Insurance approved. by the City Attorney, seconded by
Councilman Gillanders and carried.
IL League of California Cities - Request for Support of the
Peripheral Canal
City Manager Koski presented communication from the League of
California Cities requesting Council take action to support the
proposed Peripheral Canal around -the •delta of the Sacramento and
San Joaquin. Rivers. Councilman Merritt moved to support the
proposed Peripheral Canal and write letters to 'th.e. City's local
representatives in the California legislature urging their support
for early construction, seconded by Councilman Atkins and carried
on a roll call vote:

E. Amendment. to Present-Participation .Agreement with the San.
Gabriel Valley Animal Control Authority
City Manager Koski presented: proposed amendment to the Joint Powers
Agreement between the cities participating in the San Gabriel Valley
Animal Control Authority providing modification of the billing
method . based on 50% population and 50% on the number of animals
impounded.
Councilman Tyrell moved to refer the matter to a study session
February 4, 1980, seconded by Councilman Gillanders and carried,
F. Councilman Merritt advised, the Rockefeller Foundation has put
up $1 million to start a- campaign .in California to eliminate the
right of private citizens to own hand guns, and expressed concern
that the series Hawaii Five -0 has taken a political stand to take
hand guns away from the citizenry. Councilman Tyrell agreed with
Councilman Merritt.
G. Councilman Tyrell advised the Temple City Tennis Club came in
second in their first league play-off.
Councilman Tyrell also stated there seems to have been a reduction
in the number of•'false. alarms'. after .the . burglar alarm ordinance
became effective.: Mayor Dennis advised he had met with the
businesses who were- responsible for the majority of the .false alarms
and they are taking steps to .alleviate the problem„ The. Sheriff's
Department will provide an update in February for City Council
review.
H. Mayor Dennis requested possible alternatives to processing
traffic: citations be discussed at the. February 4 study session.
I. •Councilman Atkins stated he feels the City's initiating a
study: into real estate signs has had a. positive result and that
I the brokers are now aware of the problem and will police them-
selves.
J. Councilman Gillanders stated that on his recent vacation out
of .. th:e country he met many - people . from other countries who had
expressed their feelings that America is no longer a world leader,
stating they feel.noother country would have allowed the Iranian
situation to continue as it has.

Councilman Tyrell moved to adjourn to a joint study session with
the Temple'. City School Board. on Tuesday, January 29, 7:30 p.m.,
thereafter to adjourn to a study session to be held February 4,
1980, 7:30 p.m., seconded by Councilman Merritt and carried.
Meeting adjourned at 10:35 p.m. Next regular meeting of the City
Council will be held Tuesday, February 5, 1980, 7 :30 p,m, in the
Council Chamber of the City Hall,
