HomeMy Public PortalAbout1980-01-29 MeetingCOUNCIL MINUTES January 29, 1980 The Council of Bal Harbour Village met Tuesday, January 29, 1980 at 9:30 A.M. in the Village Hall. Present: Messrs. Beatty, Krez, Printup, Taplin and Miss Gray Also present were Fred Maley, Village Manager; Mary Wetterer, Village Clerk; and Cliff Schulman, representing the Village Attorney. On motion of Mr. Beatty, seconded by Mr. Taplin and voted the minutes of December 11, 1979 were approved as submitted. Mr. Maley explained a proposed Dade County Ordinance, which will be read for the second time on February 19th, creating a Civilian Review Board over public employee actions. It was moved by Mr. Taplin, seconded by Mr. Beatty, and voted, Messrs. Beatty, Krez, Printup and Taplin, "yes"; Miss Gray, "no" that Bal Harbour Village would have no objection to this County ordinance. Mr. Maley read a letter from the Beau Rivage requesting a variance to build a tennis court within the 55' setback from theErosion Control Line. He explained that the hotel may have to petition the State of Florida to extend __r.to the public portion of the beach for some of the court if it cannot fit behind the control line. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted, Messrs. Beatty, Printup and Miss Gray, "yes", Mr. Krez,"no", to grant the variance. Mr. Maley explained that four years ago a law was passed requiring all roads in Florida to be classified into four catagories of ownership; State, County, City and State Park Roads. He said 96th Street from the ocean to I-95 was to be classified as a State Road, but clue to a Special Act of the Legislature allwoing Bay Harbor Islands to own the causeway, and the fact that the State will not assume liability for sidewalks, land- scaping, etc. he feels it is in the best interest of Bal Harbour, Bay Harbor and Surfside to oppose State ownership of the road through our communities. It was moved by Mr. Taplin, seconded by Mr. Krez and voted that Bal Harbour should advise the State of Florida that we wish to maintain ownership of this Street. Mr. Printup explained the $137,500 matching grant program of the Tourism Department, which is part of their overall ad- vertising budget. Applications for grants were submitted by the Americana, Beau Rivage, Singapore, Ivanhoe, Regency, Sea View, Harbour House, Coco's and Zodiac Restaurant. On motion of Mr. Beatty, seconded by Mr. Taplin and voted the grants were approved. The Council discussed the financial statement for the first three months operation. On motion of Mr. Taplin, seconded by Miss Gray, and voted the statements were filed for audit. Mr. Maley told the council that we made the payment to the City of Miami Beach in final settlement of the water rate case. He explained that due to the water rate cases, the Water Department had been subsidized by the General Fund dur- ing 1978-79 fiscal year. He asked that the $32,547.44 inter - fund balance due the General Fund be written off, as the Water Department will be faced with large capital expenditures when the new water lines are constructed to serve the village. It was moved by Mr. Taplin, seconded by Miss Gray and voted that the write-off be approved. Mr. Schulman said that we have a motion in court to re- duce the 35 escrow account under the North Miami Beach Water case to 20t because North Miami Beach was going before the Dade County Water and Sewer Board to have lower rates approved. Mr. Printup and Mr. Maley explained that the contractor building Mr. Looby's apartment building objected to our noise ordinance, which confines construction during the winter months to 9:00 A. M. to 5:30 P.M. It was the council's decision that the existing law would be enforced. Mr. Krez said he would like to .recognize Miss Gray for recently completing her Masters Degree in Business Administra- tion. The council and Mr. Gimel of the Bal Harbour Resort Association discussed the possibility of upgrading of street lighting, sidewalks and median strip on Collins Ave. it was moved by Mr. Krez, seconded by Miss Gray and voted to have the village manager advertise for bids for electrical engineers to submit preliminary plans for this work. Mr. Maley reported that he and Mr. Taplin and a member of the Resort Tax Advisory Committee met with the Assistant Director of Dade County Parks and three others from Dade County regarding improving the Haulover tennis court complex. Resi- dents from Camelot Hall present informed the council that the courts at Bakers Haulover close at 1:00 P.M. The council agreed to contact Commissioner Ruvin regarding longer playing hours and cleaning up around the tennis site, also about the constant noise from helicopters. Mr. Krez stated he was dissatisfied with the contractor doing the village hall addition and asked Mr. Maley to set up a meeting with him for next Thursday. Mr. Maley said that Mr. Jack Jones has resigned from the Library Advisory Committee and that we need a replacement for him and another resident to act as an alternate. Mrs. Evelyn Silverman offered her services and also the name of Julia Rosenthal was submitted. It was moved by Mr. Taplin, seconded by Miss Gray and voted to appoint Mesdames Silverman and Rosenthal to the committee to serve with Mrs. Esther Schwartz. January 29, 1980 Mr. Schulman advised that the Bal Harbour 101 builders had gone before a Special Master and had the building's assessed value reduced by $8,000,000. Mr. Schulman said that Mr. Gold believes the Special Master had erred and wants permission to join Dade County in fighting this decision. It was moved by Mr. Taplin, seconded by Mr. Krez and voted that Mr. Gold file suit or join in the County suit against this decision. Mr. Maley and Mr. Schulman reported that Mr. Gold was asking Miami Beach to continue the sewer contract that is expiring until the new plant is in operation. On motion of Mr. Taplin, seconded by Miss Gray the meeting was adjourned at 11:10 A.M. Present: Miss Gray and Messrs. Beatty, Krez, and Printup Absent: Mr. Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Krez and voted the minutes of January 29, 1980 were approved as submitted. Mr. Stanley Whitman, Chairman of the Resort Tax Advisory Committee reported that after a meeting with Dade County Park system officials he had contacted Commissioner Harvey Ruvin who advised that he would endeavor to have the parkimprovements done by Dade County. He said there will be another meeting with Dade County officials and Mayor Printup would be present. Mr. Maley reported that the tennis courts are now operating until 4:00 P.M. February 26, 1980
