PROFESSIONAl, SERVICE CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to provide engineering
and laboratory services required in connection with the underground storage tank
removal at the Cartcret Police Station; and
WHEREAS, engineenng services are a professional service exempt from the
requirement of public bidding pursuant to N.J.S.A. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officcr has certified that funds are available..
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Cmteret does hereby approve the appointment of Killam Associates at
a maximum cost not to excecd $7,250.00 billable per attached contract.
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that thc contract is awarded without competitive
bids in accordance with N.J.S.A. 40A:11-5 (1) (a) due to the spccialized and
professional nature of the scrvices provided.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home Ncws Tribune on April 29, 2000.
Adopted this 24th day of April, 2000
and certified as a true copy of the original
on April 25, 2000.

As per Resolution Number 00-138.
THE CONTRACTOR does hereby agree to perform thc following
PROFESSIONAL SERVICE CONTRACT TO PROVIDE ENGINEERING AND
LABORATORY SERVICES REQUIRED IN CONNECTION WITH THE
UNDERGROUND STORAGE TANK REMOVAL AT THE CARTERET POLICE
STATION.
NOT TO EXCEED $7,250.00
According to the terms set forth in
THE INDEMNIFICATION AGREEMENT ON
THE REVERSE OF THE PURCHASE ORDER
SHALL BE LIMITED TO THE VENDOR'S
NEGLIGENT OR WRONGFUL ACTS.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
IN WITNESS WHEREOF, the parties hereto have hereunder set their hands and seals or
caused these presents to be siged by their proper corporate officers and their corporate
seals to be hereto affixed, the day and year written above.
