AWARDING CONTRACT FOR THE WILLOW STREET AND
CHARLOTTE STREET RECONSTRUCTION PROGRAIH
'VHEREAS, the Borough of Carteret ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Willow Street
and Charlotte Street Reconstruction Program; and
, \VHEREAS, the Borough has previously received bids for said project on September 4, 2008;
and
\VHEREAS, the Borough's Consulting Engineer for the project, T &M Asspciates, has advised
the Borough that the apparent low bidder, DeFino Contracting, Co. had not submitted the
requisite Disclosure of Ownership information; and
\VHEREAS, the Disclosure of Ownership, as the bid documents clearly stated, is a required item
in accordance with N.J.SA. 52:25.24.2 and that failure to submit this document mandates
rejection of the bid.
WHEREAS, Star of the Sea, 448 Marlboro Road, Old. Bridge, New Jersey submitted the next
lowest responsive bid-Jor said work as evidence by the response on file with the Borough's
Purchasing Department and Borough's Consulting Engineer for the Project as follows;

'VHEREAS, the Borough's Consulting Engineer, T & M' Associates, has reviewed the above
referenced bid proposal(s) and has recommended an award of a contract for the Base Bid; and
"'HEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
availableJor the award of a contract for said work.
NOW THEREFORE BE J11 RESOLVED by the Mayor and Council of the Borough of
Carteret;County 9fMiddlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the \Villow Street and Charlotte
Street Reconstruction Progrant to Star of the Sea, Old Bridge, New Jersey, in the
amount of$384,957.43 for the Base Bid.

2, That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract ,,'ith Star of the Sea for the 'Villow Street and Charlotte
Street Reconstruction Program in the amount of $384,957.43 and in accordance
in all respects with the request for proposals and bid on the same.
3. That the Bid submitted by DeFino Contracting Co. without proper documentation
in accordance with N,J.S.A. 52:.25-24,2 is hereby rejected as required by law and
the bid documents. .
4. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department and T &M Associates for distribution to Star of the Sea.
