had gone before a Special Master and had the building's
assessed value reduced by $8,000,000. Mr. Schulman said
that Mr. Gold believes the Special Master had erred and
wants permission to join Dade County in fighting this decision.
It was moved by Mr. Taplin, seconded by Mr. Krez and voted
that Mr. Gold file suit or join in the County suit against
this decision.
Mr. Maley and Mr. Schulman reported that Mr. Gold was
asking Miami Beach to continue the sewer contract that is
expiring until the new plant is in operation.
On motion of Mr. Taplin, seconded by Miss Gray the
meeting was adjourned at 11:10 A.M.

COUNCIL MINUTES
February 26, 1980
The Council of Bal Harbour. Village met Tuesday, February
26, 1980 at 9:30 A.M. in the Village Hall.
Present: Miss Gray and Messrs. Beatty, Krez, and Printup
Absent: Mr. Taplin
Also present were Fred W. Maley, Village Manager; Mary
T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Krez and voted
the minutes of January 29, 1980 were approved as submitted.
Mr. Stanley Whitman, Chairman of the Resort Tax Advisory
Committee reported that after a meeting with Dade County Park
system officials he had contacted Commissioner Harvey Ruvin
who advised that he would endeavor to have the parkimprovements
done by Dade County. He said there will be another meeting
with Dade County officials and Mayor Printup would be present.
Mr. Maley reported that the tennis courts are now operating
until 4:00 P.M.

Mr. Whitman also requested that Bal Harbour require
civilian identification cards for anyone working in Bal
Harbour. Mr. Maley explained that our present policy makes
it optional. Mr. Gold said he would report to the council
next meeting on the legality of such an ordinance.
Mr. Gold reported that Mr. Farrell, our attorney handling
the Balmoral tax litigation, is presently taking depositions
and the trial date will be set as soon as he is finished with
this process. In regard to the Bal Harbour 101 dispute
he said we must intervene through the Dade County suit.
RESOLUTION NO. 270
requesting participation in the 1979 Justice System
Improvement Act funding as part of the Dade County applica-
tion was read by the Village Clerk. On motion of Mr. Beatty,
seconded by Miss Gray and voted the Resolution was adopted.
Mr. Maley explained that the rates for future water
purchases from Miami Beach and North Miami Beach have been
settled for the time being, except for the escrow settlement
with North Miami Beach. He said he would prefer not to
lower water rates now and then have to raise them next year
when we will be faced with paying for the new water line
which Dade County willbuild from Miami Beach. Mr. Maley
also reported that in July or August we will be faced with
a large sewage treatment charge from Miami Beach for sewage
treatment when they hook up to the Virginia Key treatment
plant. This will be around 23 :in addition to the 6G per
thousand gallons we are now paying. He requested the coun-
cil to allow him to get proposals from Arthur Anderson and
Co. and other firms to study and advise us on future water
and sewer rates. On motion of Mr. Beatty, seconded by
Miss Gray and voted Mr. Maley was authorized to seek pro-
posals.
Mr. Maley said he had advertized under the Competetive
Negotiations Act for electrical engineers for the street
lighting improvements and had three firms answer. He said
he evaluated the three firms responding; Stinson and Martinez
Inc.: Ferendino Grafton Spillis Candella; and Schimpeler-
Corradino Associates and had selected Stinson and Martinez
for the design of the Collins Avenue decorative lighting
and the residential street lighting renovations. It was
moved by Mr. Krez, seconded by Miss Gray that we retain the
firm of Stinson and Martinez, Inc. for this work.
Mr. Maley reported that he had written the City Manager
of North Miami Beach and offered to sit down and negotiate
a water settlement and he was advised that they are not ready
to do this. Mr. Gold said that we had worked out a contract
settlement but it had not been approved by North Miami
Beach. He suggested that we hire Warren Silverman who has
worked on the Miami Beach water case to study the North
Miami Beach matter so that the Village would be able to
make a sum certain offer to North Miami Beach. It was
moved by Mr. Beatty, seconded by Mr. Krez, and voted that
Mr. Silverman be retained at $75.00 per hour to make rec-
ommendations for the settlement.

Mr. Maley said the managers of Surfside, Bay Harbor,
and Bal Harbour met with the District Engineer of the Florida
Department of Transportation and they feel they may not have
the option of letting the three towm retain control of 96th
Street as they believe the road was properly classified for
the State ownership. Mr. Maley said DOT will research the
matter to see if the street can be reclassified.
Mr. Gold said that during a recent hearing of the State
Attorney's office regarding the shooting at the Americana
Hotel, he felt that Sergeant Garrett should have separate
counsel as he felt he may have a conflict if civil suit is
filed. He reported that the State Attorney found no cause to
take action. He wished to present a bill for payment in the
amount of S200.00 from Paul Lipton, the attorney he had called
to represent Sgt. Garrett. It was moved by Mr. Krez, seconded
by Miss Gray to pay the submitted bill.
Mr. Gold said that obtaining insurance for the police
department had been discussed previously, but he feels that
the village should carry insurance against police actions.
The Mayor requested Mr. Maley to bring figures in for the
next meeting on police liability.
On motion of Miss Gray seconded by Mr. Beatty the meet-
ing was adjourned at 10:50 A.M.
