Call to Order: The Meeting was called to order on the second floor at 7:00 PM. 2. Acceptance of Minutes — February 24, 2011, March 10, 2011 (being transcribed). The Minutes were not ready for review and approval. 3. Old Business. A — A brief discussion was held regarding the status of Mr. Wirtanen's review. B — 7 School Street — Septic system failure. Mr. Wirtanen stated he got word from DEP that the Board of Health is considered the tie breaker in deciding passing and failing Title 5 inspections. He stated in response to that, he has drafted a policy to help the Board if this happens again. Mr. Gates stated he doesn't agree with the deep test hole requirement in the policy. Mr. Wirtanen stated it would help to avoid future inspections. Mr. Gates stated he wouldn't want to expose the Town to liability. He stated he feels this should be a Regulation, not a policy if Mr. Wirtanen feels strongly with moving forward with it. Mr. Wirtanen stated if the homeowner wants a second inspection, they would need to follow a set policy or the Board could decide not to accept second inspections. Mr. Lawler stated he feels as though the Board shouldn't be involved in deciding whether a system passes or not. Mr. Gates stated he doesn't have a problem with Board of Health staff witnessing an inspection, but they could also ask how the groundwater was determined. He stated deep hole tests aren't that good of an indicator of the cause of system failure and he doesn't see the Board imposing a new requirement that may not be legal or useful. Mr. Lawler asked if they should get more clarification from the state. C — Update Public Health Planner Request for Proposals. Mr. Wirtanen gave the Board an update and let them know he would be attending the interviews on March 29th D — 2011/12 Draft Contractor Contracts. Mr. Wirtanen stated he added something Mr. Besso was already doing to his contract. He stated he added temporary/seasonal food vendors to Ms. Grossman's contract. He showed the Board a sample invoice for the Food Inspector and noted it includes information about her next day she will be in Town. AA — Site Plan Review Application- Southwest Village at Legacy Farms. Mr. Wirtanen stated the applicant wants to start construction at the end of this summer. He stated the Board of Health will be inspecting the common areas and pools at the development. He noted the applicant has not yet paid the review fee associated with these plans. Mr. Lawler made a motion to allow Mr. Wirtanen to respond to the Planning Board with comments on Southwest Village. Dr. Wright seconded the motion and all members voted in favor. BB — Report of the US Geological Survey. Mr. Wirtanen gave the Board some information about the possibilities of Uranium and Arsenic in the groundwater in Town. Mr. Lawler suggested posting the information on the Town's website. CC — Correspondence. Mr. Wirtanen stated the Maillet Woods Condo Trust is fighting with the developer to try and get their new well installed. Mr. Wirtanen gave the Board a memo from DEP regarding a dispute between Title 5 regulations and the Plumbing Code. DD — Other. Mr. Wirtanen stated the Electronic Comprehensive Emergency Management Plan has been updated for the Town. Mr. Wirtanen stated he got some information regarding the possibility of food coming from Japan and keeping imports safe. Documents Used: Undated letter from DEP. Appointments: 7:15 PM. Definitive Subdivision Application Bridle Path. Mr. Wirtanen stated there are Boston Edison easements listed on the plan, but he hasn't received any documentation regarding their abandonment. He stated they are proposing 6 lots with 5 bedroom's each. He stated he feels they should perform a new Noise Evaluation Study instead of using old data. Mr. Lawler made a motion to approve the subdivision plan and submit comments to the Planning Board. Dr. Wright seconded the motion and all members voted in favor.
