RESOLUTION NO. e4 - s38
RESOLUTION GRANTING FINAL APPROVAL
FOR ANGUS ESTATES
WHEREAS, Charles T. Hvass and Barbara A. Hvass and Martin B. Schneider
(Applicants) have requested approval to plat a parcel located near Medina
Road, Mohawk Road and Co. Rd. 24 to be known as Angus Estates; and
WHEREAS, the City Council has reviewed the final plat and compared it
with the plat previously given preliminary approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota, that final approval is granted to the Applicants for Angus Estates,
subject to the following conditions:
1. The Applicants shall enter into a private road agreement in a
form satisfactory to the city attorney;
2. The Applicants shall pay to the city a park dedication fee in
the amount determined by the city staff;
3. The Applicants shall dedicate to the City the right-of-way for
County Road 24, Mohawk Drive and, if necessary, Medina Road, as
specified by the city staff;
4. The city staff is directed not to release the plat until the
Applicants have submitted to the city attorney evidence of the
satisfaction of the mortgage on the property;
5. Martin B. Schneider shall join in dedications on the plat;
6. The Applicants shall pay to the city for administrative expens-
es the amount determined by the city staff to represent the
actual cost to the city of reviewing the subdivision;
7. The Applicants shall execute an affidavit regarding whether
there have been any encumbrances placed against the property
since the date of certification of the abstract used by the
city attorney to examine the condition of title; and
8. The Applicants shall file the final plat of record within 60
days of the date of adoption of this resolution. Failure to
file the final plat within such period of time shall render the
City's approval null and void.
