CLK/CT 155 Rev. 48116 Cleric's web address: www.miami-dadeclerk.com RESOLUTION NO. 2017-58 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING A SITE PLAN FOR A TWO-STORY CLUBHOUSE AND ACCESSORY STORAGE BUILDING AT THE KEY BISCAYNE YACHT CLUB, 180 HARBOR DRIVE, PROVIDING FOR FINDINGS; PROVIDING FOR CONDITIONS; PROVIDING FOR RECORDING; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, pursuant to Section 30-73 of the Village of Key Biscayne ("Village") Code of Ordinances ("Code"), Key Biscayne Yacht Club, Inc. ("Applicant") submitted a Planning and Zoning Application bearing Public Hearing No. SP -27 ("Application") seeking approval of a site plan for the development of a two-story clubhouse and an accessory storage building at the property located at 180 Harbor Drive as more fully described in the legal description attached hereto as Exhibit "A" ("Property"); and WHEREAS, on December 12, 2017, the Village Council conducted a duly -noticed public hearing and considered the Application in its entirety, as well as all testimony and other evidence presented and otherwise made part of the record. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS: Section 1. Recitals. Each of the above -stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Findings. The Village Council, based upon the competent substantial evidence presented, finds that the Application is consistent with the Village's Master Plan and that the Applicant has met all of the applicable requirements within the Village's Zoning Code, and in particular Section 30-73 of the Village Code. Page 1 of 5 Section 3, Site Plan Approved. The following plans prepared by Peacock & Lewis Architects and Planners, LLC dated November 3, 2017, October 12, 2017, and November 26, 2017, and consisting of sheets P-1 through P-14, L-1, and C-1 through C-3, respectively, reduced copies of which are attached hereto as Exhibit "B," are hereby approved subject to the conditions in Section 4 below. Section 4. Conditions. The approval granted by this Resolution is subject to compliance with the following conditions: a. The Applicant shall record, at its expense, a Declaration of Restrictive Covenant in lieu of Unity of Title, in a form approved by the Village Attorney, for the Property in the public records of Miami -Dade County, Florida prior to the issuance of a building permit. b. The Applicant shall address the Fire Departments comments on the Application at the tirne of permitting review and plans shall be modified accordingly. c. All dumpsters shall be constructed of concrete block and stucco. The building material for the dumpster gates shall only be comprised of metal. d. The Property contains a variety of palm trees and canopy trees. Page L2 lists those existing trees which will be removed or retained on the site. Prior to demolition, the Village shall have the opportunity to remove those trees that will not be retained on site and place them on public property. The relocation cost shall be at the expense of the Applicant. Page 2 of 5 e. The Hacienda Canal Overlook furnishings listed on Page L-1 must be approved by the Planning and Public Works Directors at or before the issuance of the first building permit. f Minor revisions to the Site Plan due to unforeseen circumstances, such as site conditions, shall not require Village Council review. g. The Development Services Director shall approve the design of the plans for the 2,300 square foot accessory building located on Parcel B of the Property (known as the "Weaver property") which shall be consistent with the architecture of the two-story clubhouse. An adequate landscape buffer shall be provided between the surrounding single-family residential properties and the accessory building. Section 5. Recording. This Resolution shall be recorded, prior to the issuance of a building permit, by the Applicant at its expense in the public records of Miami -Dade County, Florida. A copy of the proof of recordation shall be submitted to the Village Clerk prior to the issuance of any building permits. Section 6. Effective Date. This Resolution shall be effective immediately upon adoption. Section 7. Appeal. Any appeal of the approval granted under this Resolution shall be filed within 30 days of rendition in accordance with Rule 9.100(e) of the Florida Rules of Appellate Procedure.
