RESOLUTION N0 .
RESOLUTION ADOPTING AMENDED ASSESSMENTS
FOR HAMEL SEWER REPAIR PROJECT
WHEREAS, PURSUANT TO Resolution 87-109, adopted by the Medina City
Council on October 6, 1987, Alpanan Aluminum Products, Inc. was
assessed for the Hamel Sewer Repair project in the amount of $4680.;
and
WHEREAS Alpana Aluminum Products, Inc.( Donald Klitzka, Pres.), owners
of said property against which assessments were levied, appealed their
assessments to Hennepin County Distruct Court; and
WHEREAS THE City and the appellants have reached an agreement regarding
the amount to be assessed against the appellant's property and have
entered into a Sipulation for dismissal regarding the matter.
NOW, THEREFORE, Be it Resolved by the City Council of the City of
Medina, MInnesota, as follows:
1. An amended assessment in the principal amount of $3,000 against
Parcel 12-118-23 23 0002 is hereby adopted and shall constitute the
special assessment against the land. The land is hereby found to be
benefited by the improvement in the amount of the assessment so levied.
2. The stated amount of $3,000 shall be payable in full to the City
of Medina within 20 days after adoption of this resolution.
3. Appellant waves its right to notice of hearing and hearing on the
reassessment provided for in this Stipulation.
4. Appellant waives its right to appeal the reassessment provided for
in this Stipulation.
