RESOLUTION NO. (fg - 4/.4
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO JAMES AND REBECCA PETERSON
WHEREAS, James and Rebecca Peterson (Applicants) have requested a
conditional use permit for an accessory structure of 5,776 square feet to be
constructed on Lot 1, Block 1, Willowood, which lot is approximately 23 acres
in area; and
WHEREAS, the accessory building will contain horse stalls, living area
and machine storage and will have attached to it a riding ring; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
for any accessory structure in excess of 3,000 square feet on a lot three
acres or greater in size; and
WHEREAS, this request was reviewed by the planning commission on May 10,
1988, at which time the planning commission recommended approval, with condi-
tions; and
WHEREAS, it has been determined that the existence of a large accessory
structure on this property will not impede the orderly development of adjacent
propeties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota, that a conditional use permit be granted to the Applicants for the
stated purpose, subject to the following terms and conditions:
1. The accessory structure shall be used solely for private, non-
commercial purposes. There shall be no horse boarding and no
horse shows shall be held at the facility;
2. The Applicants shall cause manure to be removed from the area
in accordance with PCA standards;
3. The city engineer shall review the bridge to ensure that it is
of adequate size to accomodate fire equipment;
4. The Applicants shall control runoff from the riding ring and
the area used for manure storage in a manner satisfactory to
city staff;
5. The number of cubic yards of dirt to be moved on the site shall
be reviewed by city staff;
6. There shall be no exterior loudspeakers on the property;
7. The maximum number of live-in employees to be allowed on the
property shall be three;
8. The maximum number of horses to be kept on the property at one
time shall be 12;
9. The Applicants shall submit their site plan for review by the
fire department;
10. A11 exterior lighting on the property shall be residential in
character;
11. The Applicants shall submit a landscaping plan to be approved
by city staff;
12. The accessory building shall comply with all city ordinances,
including setback requirements; and
13. The Applicants shall pay to the City a fee in the amount deter-
mined by the city staff to represent the actual cost to the
City of reviewing this conditional use permit application.
