N O W , T H E RE F O RE , B E IT RE SO L V ED B Y T H E V IL L A G E CO U N CIL O F TH E V IL L A G E O F K E Y B ISC A Y N E , FL O RI D A A S FO L L O W S: Section 1. R eci tals. Each of the above-stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Findings. The Village Council, based upon the competent substantial evidence presented, finds that the Application is consistent with the Village's Master Plan and that the Applicant has met all of the applicable requirements within the Village's Zoning Code, and in particular Section 30- 73 of the Village Code. S e c t io n 3 . S ite P la n A p p r o v e d . The following plans prepared by Hamed Rodriguez Architects, Inc., dated March 21, 2023, reduced copies of which are attached hereto as Exhibit "A," are hereby approved subject to the conditions in Section 4 below. Section 4. Conditions. The approval granted by this Resolution 1s subject to compliance with the following conditions in which the Applicant has agreed: A. In accordance with Florida law, the Applicant shall enter into a Transportation Proportionate Share Mitigation Agreement between the Village and the Applicant, collectively referred to as (the "Parties"), regarding necessary mitigation required for construction of certain roadway improvements to address the deficiency of transportation link s, which are currently overcapacity and operating below the Village's adopted Level of Service, as provided for in the Transportation Proportionate Fair Share Agreement regarding road improvements to the intersections of Crandon Boulevard and Harbor Drive (the "Agreement"). The proportionate fair share calculation, totaling $115,115.48 is agreed upon by the Parties and is the Applicant's proportionate fair share contribution ("Proportionate Fair Share") required under Chapter 163 .3180, Florida Statutes and necessary for construction of the transportation improvement. The Applicant shall submit payment of the requisite Proportionate Fair Share prior to issuance of a Building Permit or within sixty (60) days from the effective date of this Resolution, whichever occurs first. B. Applicant shall submit a payment of $115,115.48 to the Village for general transportation/traffic mitigation purposes prior to issuance of a Building Permit or within sixty (60) days from the effective date of this Resolution, whichever occurs first. C. The minimum parking facilities required by the Village's Zoning and Land Development Regulations for each use on the Property shall be maintained and continued for as long as each use giving rise to the requirement is continued. D. Parking substitutions allowing the replacement of vehicular parking with golf cart and bicycle parking are not permitted unless a permanent legal route is available for golf carts to access the Property's parking lot. Golf carts are currently prohibited from using Crandon Boulevard outside Village limits. E. The Property must continuously provide and maintain at least four ( 4) Electric Vehicle 2 (EV) charging stations. F. Issuance of this development permit by the Village does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the Village for issuance of the permit if the Applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. G. The Applicant shall grant to the Village stormwater drainage easements along the north, south, and west property lines, which stormwater easements shall be a minimum often feet in width. The stormwater drainage easements shall be provided in a separate Grant of Easement Agreement recorded in the Official Public Records of Miami-Dade County in a form acceptable to the Village Attorney. H. All mechanical equipment located on the roof of the commercial building to be developed on the property shall be entirely screened from view. I. Subject to approval by the Village Manager or Village Manager's designee, the padel tennis courts located on the property shall be screened from view from the public rights­ of-way and developed with a barrier that prevents padel tennis balls from escaping the padel tennis court area. J. All applicable local, state, and federal permits must be obtained before commencement of the development. S ection 5. R ecording. This Resolution shall be recorded, prior to the issuance of a building permit, by the Applicant at its expense in the public records of Miami-Dade County, Florida. A copy of the proof of recordation shall be submitted to the Village Clerk prior to the issuance of any building permits. S ection 6. adoption. E ffective D ate.
