A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, F'LORIDAO APPROVING
THE VILLAGE MANAGER'S SECOND REVISION TO
ADMINISTRATIVE ORDER NO. 1 SETTING A NEW
STORMWATER UTILITY FEE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on June 22, 1993, the Village of Key Biscayne (the "Village") adopted
Ordinance No. 93-11 (Chapter 29 of the Village Code of Ordinances) and established a
Stormwater Utility within the Village; and
WHEREAS, Section 29-4 of the Village Code of Ordinances provides that stormwater
utility fees shall be set by Administrative Order of the Village Manager after approval by the
Village Council; and
WHEREAS, on October 12, 1993, the Village Council adopted Resolution No. 93-46
which approved Administrative Order No. 1 and set the initial stormwater utility fee at $5.00 per
ERU (Equivalent Residential Unit); and
WHEREAS, on March 8,2011, the Village Council adopted ResolutionNo.20ll-4,
approving the Village Manager's Revised Administrative Order No. 1, setting the stormwater
utility fee at $8.90 per ERU; and
WHEREAS, after careful review and consideration, the Village Manager is
recommending a second revision to Administrative Order No. 1 setting a new stormwater utility
fee at $16.90 per ERU; and
WHEREAS' the Village Council believes that this stormwater utility fee increase is fair
and reasonable and supported by the data and analysis contained in the Village staff report
entitled "Stormwater Utility Fee" and dated August 27,2019; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section I Recitals Adopted. Each of the above stated recitals are hereby adopted,
confirmed and incorporated herein.
Section 2. Revised Administrative Order Anproved. That the Village Council
hereby approves the Village Manager's second revision to Administrative Order No. 1, as
provided in Exhibit'0A," setting a new stormwater utility fee at $16.90 per ERU per month.
Section 3. Effective Date. This Resolution shall be effective immediately upon
adoption.

SECOND REVISION TO ADMINISTRATIVE ORDER No. 1
Pursuant to the Stormwater Utility Ordinance No. 93-11 (Section 2g of the
Village Code of Ordinances) adopted on June 22, 1993, the Stormwater Utility Fee for
the Village of Key Biscayne is hereby set at $16.90 per ERU (Equivalent Residential
Unit) per month.
This second revision to Administrative Order No.1 is approved on August 27,
2019 and will be effective on same that and willsupersede the Stormwater 0tifty fee
previously set by Revised Administrative Order No,1, approved on March g,2Ai1,by
Resolution No. 201 1-4 ol the Village Council.
