and Bal Harbour met with the District Engineer of the Florida
Department of Transportation and they feel they may not have
the option of letting the three town retain control of 96th
Street as they believe the road was properly classified for
the State ownership. Mr. Maley said DOT will research the
matter to see if the street can be reclassified.
Mr. Gold said that during a recent hearing of the State
Attorney's office regarding the shooting at the Americana
Hotel, he felt that Sergeant Garrett should have separate
counsel as he felt he may have a conflict if civil suit is
filed. He reported that the State Attorney found no cause to
take action. He wished to present a bill for payment in the
amount of $200.00 from Paul Lipton, the attorney he had called
to represent Sgt. Garrett. It was moved by Mr. Krez, seconded
by Miss Gray to pay the submitted bill.
Mr. Gold said that obtaining insurance for the police
department had been discussed previously, but he feels that
the village should carry insurance against police actions.
The Mayor requested Mr. Maley to bring figures in for the
next meeting on police liability.
On motion of Miss Gray seconded by Mr. Beatty the meet-
ing was adjourned at 10:50 A.M.

March 25, 1980
February 26, 1980
The Council of Bal Harbour Village met Tuesday, March
25, 1980 at 9:30 A. M. in the Village Hall.
Present: Miss Gray and Messrs. Beatty, Krez, Printup
and Taplin
Also present were Fred W. Maley, Village Manager; Mary
T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Krez and voted
the minutes of February 26, 1980 were approved as submitted.
Mr. Maley reported that we have a request from Bay
Harbor Islands for payment of one half the cost of the new
24" water line from Byron Avenue to Indian Creek. Mr.
Gold is drafting a joint ownership agreement. It was
moved by Mr. Taplin, seconded by Miss Cray and voted
that as soon as the agreement is ready we will pay the
S54,000 for our share of the line.
Mr. Printup advised that he had atteneded two (2)
meetings with the heads of the Dade County Parks Depart-
ment, the Resort Tax Advisory Committee, and Mr. Whitman
regarding tennis facilities. He said that interest is
now being shown by the Sunny Isles Resort Association
and that with the interest shown by Dade County, spear-
headed by Commissioner Ruvin, the tennis facilities at
Bakers Haulover have already shown some improvement as
to operating hours. The group will meet again to discuss
funding to light the six courts at Haulover Park.
Mr. Gold discussed the legality of issuing police
identification cards to employees of business establish-
ments in Bal Harbour. It was moved by Mr. Taplin, seconded
by Mr. Krez and voted that an ordinance be prepared re-
quiring that all employees working in any capacity in
Bal Harbour apply for Police Identification cards.
Mr. Gold reported that a meeting will be held by
the end of this month with the officials of North Miami
Beach to discuss the water rate settlement.
Mr. Gold presented a tentative set of rules for the
beach containing only those that relate to public health,
welfare and safety such as use of vehicles, damage to
village property, prohibiting animals, building of fires,
erection of structures and use of weapons. He said other
provisions are covered under state law. It was suggested
that this item be held for the next meeting and in the
meantime Mr. Maley should get some information on public
lavatories and drinking fountains. Mr. Maley said he
would contact the state and see if they could be erected
on public land.
Mr. Maley said the contractor doing the village hall
renovations had presented a change order to instal]. a
pocket partition for the glass doors at the rear of the
council chamber. After discussion on motion of Mr. Krez,
seconded by Miss Gray and voted the order was rejected.
Mr. Maley said he had again discussed with our in-
surance agent the purchase of Police Liability Insurance.
Mr. Gold said this should be purchased for both the officers'
and village's protection. It was moved by Mr. Beatty,
seconded by Mr. Krez and voted that Mr. Maley have prices
on this insurance for next meeting.
Mr. Maley reported he had been meeting with our
pension actuaries in regard to the pension changes requested
by the police department. He said the actuaries have
also pointed out the liability the council has as the
pension board and they are concerned about the fiduciary
liability. Head-Beckam Insurance Company will have fig-
ures on this type of insurance next month.
Mr. Russell K. Thirkell, Vice President of the
Intercontinental Bank, appeared before the councilto
ask that their bank be considered for the village's bank-
ing services, no action was taken.
On motion of Mr. Krez, seconded by Mr. Taplin the
meeting was adjourned at 1.0:30 A.M.

COUNCIL MINUTES
April 29, 1980
The Council of Bal Harbour Village met Tuesday, April
29, 1980 at 9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Printup, Taplin and Miss Gray
Also present were Fred W. Maley, Village Manager;
Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village
Attorney.
Mayor Printup reported that Mr. Krez has resigned
from the Council insasmuch as he has sold his home and moved
to another district in the village. After discussion it
was moved by Mr. Beatty, seconded by Miss Gray and voted,
that Mr. Krez be appointed to fill the vacancy on the council,
for the unexpired term ending in 1981. Mr. Leonard Krez
was then sworn into office by the Village Clerk.
On motion of Mr. Taplin, seconded by Mr. Beatty, and
voted, the minutes of March 25, 1980 were approved as sub-
mitted.
Mayor Printup opened a Public Hearing on the proposed
expansion of the Bal Harbour Shops parking structure, lo-
cated in the Business District.
Mr. Gold read the traffic survey requirements from the
zoning code, and said that this hearing would be to con-
sider the traffic survey submitted by Bal Harbour Shops. Mr.
Maley said that the traffic survey, prepared by Harland
Bartholomew S Associates, shows that the traffic level
will not be at level "D" or worse and that the proposed
plans for the second and third deck comply with the set
back requirements. The plans for the parking garage show a
future department store over the west mall building, pro-
