FOR A DEMOLITION WASTE MANAGEMENT FACILITY WHEREAS, SKB, Inc. (Applicant) has applied for permission to locate a demolition waste management facility (Facility) on land located near the intersection of Hamel Road and Pioneer Trail (Property); and WHEREAS, in order to accomodate the Applicant's request it would be necessary for the City to amend the text of its zoning ordinance, rezone the Property, and grant the Applicant a conditional use permit; and WHEREAS, the Applicant's request was considered by the planning commis- sion on April 12 and May 10, 1988, at which times the Applicant's representa- tives made presentations to the planning commission and responded to questions regarding the proposal; and WHEREAS, after consideration of the proposal and evaluation of the com- ments of the Applicant and numerous persons residing near the Property who spoke in opposition to the request, the planning commission voted to recommend denial of the request; and WHEREAS, the city council has carefully reviewed the request and consid- ered the opinions of all persons involved with the matter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that the Applicant's request for amendment to the text of the City's zoning ordinance and for a rezoning of the Property are hereby denied, for the following reasons: 1. The proposed land use is not one currently permitted in any zoning district within the City and is not one which Medina wishes to encourage within its boundaries; 2. The proposed rezoning would be incompatible with the current land use of the areas surrounding the Property; 3. The proposed rezoning would be inconsistent with the land use contemplated for the Property in the City's comprehensive plan; 4. The proposed rezoning would constitute spot zoning since the Property is not adjacent to any other non-residential parcels; 5. The proposed Facility would have a negative impact on adjacent residential properties because of noise, dust, traffic and pollution, and would tend to decrease property values on nearby tracts; and 6. Medina already has more than its share of land uses which pro- vide a benefit to the metropolitan area as a whole but which are a burden to the host community. Dated: , 1988.
