HomeMy Public PortalAbout1988-050t Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. fij- RESOLUTION GRANTING FINAL APPROVAL FOR INDEPENDENCE ESTATES WHEREAS, Dan -Bar Homes (Applicant) has requested final plat approval for the real estate which is legally described as Blocks 3, 4, 5 and 6, Indepen- dence Beach, Hennepin County, Minnesota, together with adjoining vacated road and road proposed to be vacated, and which will be known as Independence Estates. WHEREAS, the City Council has reviewed the final plat and compared it with the plat previously given preliminary approval. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final plat approval is granted to the Applicant for Indepen- dence Estates, subject to the following conditions: 1. The Applicant shall construct or reconstruct the grading, base and asphalt surfacing thirty (30) feet in width of the following streets in accordance with the specifications established by the Medina city engineer: a) Birch Street from the centerline of Maple Street to the centerline of Walnut Street, said Birch Street to be constructed with a 100 foot vertical curve; b) Maple Street from the centerline of Cedar Avenue to a point 375 feet + easterly thereof, including an asphalt curb on the southerly edge and the surface sloped toward the curb according to specifications established by the Medina city engineer, provided that the City shall pay up to $1,500 to defray all or a portion of the cost of the gravel base; and . • c) Cedar Avenue from the centerline of Walnut Street to the centerline of Maple Street, to the extent necessary to restore the street after utility construction; 2. The Applicant shall install sanitary sewer and water lines and connect them to existing municipal systems in accordance with specifications of the Medina city engineer; 3. The Applicant shall pay sanitary sewer and water connection charges as required by the City prior to the issuance of building permits; 4. The Applicant shall dedicate a utility easement over the southerly 10 feet of the subject property; 5. The Applicant shall dedicate for street and utility purposes the north 29.5 feet of Lot 4, Block 1; and 12 foot utility easements centered on all interior lot lines, provided, however, that the utility easement on the boundary between Lots 2 and 3, Block 1, and between Lots 6 and 7, Block 1, and between Lots 2 and 3, Block 2, shall be ten feet; 6. Prior to construction, the Applicant shall prepare and file an erosion control plan with the zoning administrator, which erosion control plan shall be approved by the city engineer; 7. The Applicant shall dedicate a drainage easement 10 feet in width, the centerline of which shall be on the boundary line between Lots 2 and 3, Block 2, and continuing easterly form Birch Street through Outlot A to Ardmore Creek; 8. The Applicant acknowledges that 0utlot A is an unbuildable lot until it is served by municipal sanitary sewer; 9. A11 lots shall gain access from either Cedar or Birch Avenue; 10. The Applicant shall submit the plat to the Pioneer Creek Watershed District for approval and shall comply with all requirements of the District; 11. No more than one driveway, curb cut or entrance shall be permitted on any lot; 12. The Applicant shall pay a park dedication fee in the amount determined by city staff. 13. The Applicant shall pay to the City for administrative expenses the amount determined by the City staff to represent the actual cost to the City of reviewing of the plat; 14. The Applicant shall enter into a road agreement with the City and post a bond in the amount determined by the city staff; 15. The Applicant shall execute a development contract with the City which is satisfactory to the city attorney; 16. The zoning administrator and city engineer shall review all road specifi- cations; 17. It is acknowledged that a portion of the cost of upgrading Maple Street shall be paid by Outlot A; 18. The Applicant shall execute an affidavit regarding whether there have been any encumbrances placed against the property since the date of certification of the abstract used by the city attorney to examine the condition of title; 19. The Applicant shall file the final plat of record within 60 days of the date of adoption of this resolution. Failure to file the final plat within such period of time shall render the City's approval null and void.. Dated: ATTEST: c / , 1988.
