O O -J3-.3 RESOLUTION GRANTING A VARIANCE FOR VERNAL SPANGRUD AND MARY SPANGRUD WHEREAS, Vernal Spangrud and Mary Spangrud (Applicants) have requested a variance to construct a 24' x 36' garage 15' from the side lot line on their property located at 2235 Chestnut Road; and WHEREAS, Section 826.25 of the City's zoning ordinance requires that structures maintain a minimum side yard setback of 20 feet; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request on June 14, 1988, and recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance be granted, subject to the condition that the Applicants shall have to resolve any problems which develop regarding storm water drainage onto the property to the west of their lot. The hardships which justify granting this variance include the narrowness of the lot, the location of the existing septic tank drainfield and the fact that the proposed setback would be consistent with neighborhood standards.
