G?"- J5/4 RESOLUTION GRANTING VARIANCES TO BRETT NESENSON TO PERMIT THE CONSTRUCTION OF A HOUSE ON LOT 11 AND THE EAST 20 FEET OF LOT 10, BLOCK 26, INDEPENDENCE BEACH, HENNEPIN COUNTY, MINNESOTA WHEREAS, Brett Nesenson )"applicant") has applied for variances from the requirements of Section 826.35, subd. 2 of the Medina zoning ordinance in order to construct a house on Lot 11 and the east 20 feet of Lot 10, Block 26, Independence Beach, Hennepin County, Minnesota; and WHEREAS, Section 826.35, subd. 2 requires that lots in the UR district be at least 9,000 square feet in area and maintain a 30 foot rear yard setback; and WHEREAS, the applicant proposes to construct a house within 22 feet of the rear lot line on a lot which contains only 8,000 square feet; and WHEREAS, the Medina zoning ordinance allows the city council to grant variances from the strict interpretation of the ordi- nance in the case of demonstratable hardship and if granting the variance will not violate the spirit and intent of the ordinance; and WHEREAS, the applicant appeared before the planning commis- sion on June 14, 1988 and the city council on July 5, 1988 in regard to this request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the following variances be granted to the applicant on the grounds that there is no additional land which may reasonably be added to the property to increase its size and because the rear yard setback is consistent with the existing setbacks on neighboring properties: 1. A variance is granted from Section 826.35, subd. 2 of the Medina zoning ordinace to declare the subject lot buildable at 8,000 square feet. 2. A variance is granted from Section 826.35, subd. 2 of the Medina zoning ordinance to permit the construction of a house within 22 feet of the rear lot line. BE IT FURTHER RESOLVED by the City Council of the City of Medina as follows: 3. The variances granted hereby shall be valid for a period of one year from the date of this resolution. 4. Construction of the house shall be in substantial compliance with the plans and specifications submitted by the applicant and reviewed by the planning commission and city council. 5. Construction shall be in full compliance with the city's building code and all ordinances and regulations of Medina. 6. It is hereby declared that a violation of any of the forego- ing conditions upon which the variances are granted is a violation of the Medina zoning ordinance.
