HomeMy Public PortalAbout1988-055Member uA� introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. d S3 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO DEMETRI NICOLOFF WHEREAS, Demetri Nicoloff (Applicant) has applied for a conditional use permit for an accessory recreational building on his property at 1492 Hunter Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on June 14, 1988, and by the City Council on July 5, 1988; and WHEREAS, it has been determined that the existence of an accessory structure on the Applicant's property which will be used for non-commercial purposes will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The accessory structure shall be used solely for the Applicant's private, non-commercial use; 2. The accessory structure shall not be rented out or used as living quarters; 3. The accessory structure shall be connected to the existing drainfield for the house; 4. Any change in use or ownership of the accessory structure shall be reviewed by staff for compliance with the ordinances of the City and the terms and conditions of this permit; 5. There shall be no overhead lighting on the tennis court. 6. There shall be no loudspeakers on the accessory structure or principal dwelling; 7. The Applicant shall submit a landscape plan which is acceptable to the city staff; and 8. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
