COUNCIL MINUTES
April 29, 1980
The Council of Bal Harbour Village met Tuesday, April
29, 1980 at 9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Printup, Taplin and Miss Gray
Also present were Fred W. Maley, Village Manager;
Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village
Attorney.
Mayor Printup reported that Mr. Krez has resigned
from the Council insasmuch as he has sold his home and moved
to another district in the village. After discussion it
was moved by Mr. Beatty, seconded by Miss Gray and voted,
that Mr. Krez be appointed to fill the vacancy on the council,
for the unexpired term ending in 1981. Mr. Leonard Krez
was then sworn into office by the Village Clerk.
On motion of Mr. Taplin, seconded by Mr. Beatty, and
voted, the minutes of March 25, 1980 were approved as sub-
mitted.
Mayor Printup opened a Public Hearing on the proposed
expansion of the Bal Harbour Shops parking structure, lo-
cated in the Business District.
Mr. Gold read the traffic survey requirements from the
zoning code, and said that this hearing would be to con-
sider the traffic survey submitted by Bal Harbour Shops. Mr.
Maley said that the traffic survey, prepared by Harland
Bartholomew & Associates, shows that the traffic level
will not be at level "D' or worse and that the proposed
plans for the second and third deck comply with the set
back requirements. The plans for the parking garage show a
future department store over the west mall building, pro-
jecting into the setback line, however, these plans are
not being considered at this time. After discussion by
those present on motion of Mr. Taplin, seconded by Mr. Krez
and voted the traffic survey and the plans for the expansion
of the parking garage at Bal Harbour Shops were approved.
Mr. Gold explained the background and some of the pro-
visions for the civilian identification ordinance being
considered. Mr. Gold then read the ordinance and it was
suggested that a three year history of an applicant's em-
ployment would suffice. It was moved by Mr. Taplin,
seconded by Mr. Beatty and voted that Ordinance No. 215
be passed on first reading.
Miss Wetterer read Ordinance No. 216 which establishes
new beach regulations. After suggestions regarding work
vehicles on the beach and the rights of riparian owners on
motion of Miss Gray, seconded by Mr. Krez and voted the
Ordinance No. 216 was adopted on first reading.
Mr. William Beckham, the insurance agent for Bal Harbour,
reviewed the two acceptable quotes his firm received for
our Police Liability Insurance. He recommended one pro-
posal, in the amount of $500,000, €, based on an occurance
basis, be purchased for $6,200.00. It was moved by Mr.
Beatty, seconded by Miss Gray and voted that the police
liability insurance be purchased at this time. Mr. Maley
and Mr. Beckham discussed a suggested umbrella policy in the
amount of $500,000 on the General Liability Insurance and
Fiduciary Insurance for the pension board. It was agreed
that the umbrella policy should be purchased effective
July 1, 1980. No decision was reached on the fiduciary
insurance as quotes were being received.
Mr. Maley discussed the results of the study done
by our pension actuaries regarding earlier retirement
for police officers and long term employees. Also included
were provisions for the date of participation into the
plan, normal retirement based on both age and length of
service, working beyond the normal retirement date, final
average compensation, and contribution of the state monies
by the police department. It was moved by Mr. Taplin,
seconded by Miss Gray and voted that these changes be in-
corporated into our plan and the necessary work be per-
formed by our actuaries.
Mr. Gold reviewed the North Miami Beach Water case,
including the findings of Coopers and Lybrand, Warren
Silverman, and the Dade County Water and Sewer Board. He
requested authority to file an Offer of Judgement along
with Bay Harbor Islands wherein they would have 60 days to
answer. It was moved by Mr. Taplin, seconded by Mr. Beatty,
and voted that the Village Attorney be authorized to file
the Offer of Judgement.
Mr. Maley explained that the Library Advisory Committee
has recommended that Bal Harbour increase its proportion-
ate share of the library operating cost to equal that of
Bay Harbor Islands and Surfside. Mrs. Silverman, one of
our representatives on the Advisory Committee, explained
their reasons for the recommendation. Mr. Maley told the

council that he believes that a new contract is nec-
essary to insure majority control over library policy
and budget. It was moved by Miss Cray, seconded by Mr.
Krez and voted to approve the Committee's recommendation
subject to a new agreement.
On motion of Mr. Beatty, seconded by Mr. Taplin and
voted, the Sheraton Bal Harbour was granted use of the
garage space for convention purposes through October 1980.
Mayor Printup reported that he had been contacted by
Florida International University requesting that Bal Harbour
endorse implementation of a lower division program at the
University. It was moved by Mr. Taplin, seconded by Miss
Gray and voted that Bal Harbour Village endorses this con-
cept.
Consideration of the six months operating statements
was postponed until next meeting.
Mr. Maley explained Dade County's new "Dial -a -Ride"
program to the council and it was decided to put this in-
formation in the next Newsletter.
Mr. Maley said the street light renovation plans are
ready for bid and that bids will be accepted in his office
on May 23, 1980 to be presented to the council at the May
meeting.
Mr. Ralph Gimel of the Resort Tax Board said that
the Tourism Department activities have been reviewed and
that occupancy rates are up in the hotels. Mayor Printup
presented a plaque to Miss Gray for her participation in
the Easter Parade held by the Tourism Department.
On motion of Mr. Taplin, seconded by Mr. Beatty
the meeting was adjourned at 11:50 A.M.
