CITY OF MEDINA
RESOLUTION NO. 0-6 /
RESOLUTION GRANTING A
VARIANCE FOR WILLIAM NELSON
WHEREAS, William Nelson (Applicant) has requested variances to reduce the
front yard and lakeshore setbacks for a proposed house at 2995 Lakeshore
Avenue, which property is legally described as Lots 6 and 7, Block 15,
Independence Beach, Hennepin County, Minnesota; and
WHEREAS, the applicant wishes to reduce the front yard setback from 30 to
15 feet and to reduce the lakeshore setback from 75 to 60 feet; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the
zoning ordinance be granted only when there is a demonstrated hardship because
of circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's request and
has recommended approval of it only on condition that a greater side yard
setback than is typically required be maintained from the adjacent park; and
WHEREAS, the City Council has had an opportunity to review the matter and
to hear from the Applicant regarding his request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota, that the Applicant's request for variances to reduce front yard
setback from 30 to 15 feet and to reduce lakeshore setback from 75 to 60 feet
be granted, subject to the maintenance of a side yard setback of 25 feet from
the park to the southeast. The City Council hereby finds that said variances
are valid for a period of one year from the date of adoption of this resolu-
tion and are justified due to the size of the property and the location of the
adjoining road.
