GOV aim BREl6�STE Tl1BP1 CLERK BOARD OF HEALTH MEETING WEDNESDAY DECEMBER 6, 2017 AT 7 : OOPM TOWN HALL, ROOM A Board members present : Carmen Scherzo, DVM, Chairman; Joe Ford, Vice Chairman; Mary Chaffee, RN, PhD; Annette Graczewski, MT (ASCP) and Anne Bittner Others present : Nancy Ellis Ice, RS , MPH, Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman ' s announcements The VNA in conjunction with Brewster Board of Health will be holding a child and adolescent immunization and lead screening clinic on December 18 , 2017 from 941 at the VNA office in Dennis . Appointments are required . Call 50 & 957-7423 to make an appointment. The VNA in conjunction with Brewster Board of Health will hold a blood pressure, glucose and Cholesterol screening on December 26, 2017 from 10- 12 at the Brewster Ladies library. 2 . Bass River Engineering — Title 5 and Local Variance requests for 49 Gould Drive Mr. McLellan handed out revised plans to the Board . The home is being sold and the septic system inspection failed because there are 2 cesspools and they are both to close to the pond . The new leaching will be as far away from pond as possible . The following variances are requested : 1 . To allow the proposed SAS to be less than 300 feet from Myricks Pond 2 . To allow the proposed SAS to be 15 feet from the foundation Mr . McLellan stated that the lot size is very small and that groundwater flow is away from the pond . Motion : Finding that the upgrade is an improvement, groundwater is flowing away from the pond and there is no other place on the lot for the system to go, grant the variance for the SAS to be 165 feet from Myricks Pond and for the SAS to be 15 feet from the foundation . Motion : Joe Ford Second : Mary Chaffee Vote : 5 -0-0 Action : Motion carried 3 . J. C. Ellis Design Co. , Inc . — Title 5 Variance requests for 118 Seaway Road Jason Ellis presented . The house is for sale . It currently has 2 cesspools . It is a very small lot. The new system is proposed to be in the area of the driveway. The following variances are requested : 1 . To allow the proposed septic tank to be 5 feet from the property line (parcel 9) 2 . To allow the proposed leach area to be 6 feet from the foundation wall 3 . To allow the proposed leach area to be 1 I feet from the foundation wall (parcel 9) 4 . To allow the proposed leach area to be 5 feet from the property line (parcel 9) 5 . To allow the proposed leach area to be 7 feet from the water line 6 . To allow no reserve area There will be a flow barrier around the leach area which will provide the same protection as the 20 foot setback. W W W.BREWSTER-MA . GOV BOH 12/6/ 17 Minutes Page 2 The water line will be sleeved . Mrs . Graczewski asked where the abutters system was . Mr . Ellis stated that it was on the other side of the property . Dr . Chaffee asked what was being done with the cesspools . Mr . Ellis stated that they would be filled . Motion : Finding that the water line will be sleeved, and this is an upgrade, approve the following variances : 1 . Allow the proposed septic tank to be 5 feet from the property line (parcel 9) 2 . Allow the proposed leach area to be 6 feet from the foundation wall 3 . Allow the proposed leach area to be 11 feet from the foundation wall (parcel 9) 4 . Alow the proposed leach area to be 5 feet from the property line (parcel 9) 5 . Allow the proposed leach area to be 7 feet from the water line 6 . Allow no reserve area Motion : Mary Chaffee Second : Joe Ford Vote : 5 -0-0 Action : Motion carried 4. Lot 6 Mill Pond Drive — approve Disposal Works Construction permit application Dr. Scherzo explained to the Board that this is a review and approval of the plan . Variances were granted on Feb 16, 2016 with the stipulation that the plans be approved by the Board . Mrs . Graczewski asked about the well locations and about the well protection zone . Mrs . Ice explained it. Motion : Approve the Disposal Works Construction permit application for Lot 6 Mill Pond Drive . Motion : Mary Chaffee Second : Joe Ford Vote : 5 -0-0 Action : Motion carried 5. Discuss revised Design , Operation and Maintenance of Small Wastewater Treatment Facilities regulation Mrs . Graczewski asked about the number of these systems in this town . Mrs . Ice stated that she had previously given that information to the Board and didn ' t have it with her tonight. Dr . Scherzo handed out the changes he would like to see to the Board . Mrs . Bittner asked if this regulation was more stringent than the State . Dr . Scherzo stated that it was . The large systems (over 10, 000 gallons per day) are under purview of DEP, smaller ones (2,000 — 10, 000 gallons per day) are under the purview of the BOH. The Board asked that changes be made in a different color in the regulation for discussion at another meeting . Mrs . Ice will include previous info on the number of systems . 6. Discuss proposed Septic Registration regulation This was information for the board members . Waiting to hear from Brian Baumgartel from the County . . 7. Discuss Water Quality Report regulation Dr . Scherzo spoke about this . It is basically a housekeeping issue . The only change would be to change the nitrogen loading from 3 to 2 pounds . Mrs . Ice thinks that the whole regulation should be looked at. BOH 12/6/ 17 Minutes Page 3 Motion : Change the nitrogen loading from 3 to 2 pounds to align with the Towns fertilizer bylaw . Motion : Joe Ford Second : Anne Bittner Vote : 5 -O-O Action : Motion carried 8. Discuss Planning Board application for 2672 Main Street Mrs . Graczewski asked about the apt above and if they were going to keep it. Mrs . Ice stated that she did not know. Dr. Scherzo asked if there was a change of use, do they have to come up to the Title 5 current standard? Mrs . Ice stated no if inspection passes it can stay . The Board had no comments for the Planning Board . 9. Discuss December 20, 2017 meeting No meeting. 10. Topics the Chairman did not anticipate Mr . Ford spoke about the dog park committee . BOS voted to approve a location by the police station and a grant will be applied for to cover the cost. The Dog Park Committee meets the third Thursday of the month . Mr. Ford stated that he cannot attend those meetings but does keep up with the videos . If anyone wants to attend the meeting in his place that would be fine . Joe will continue on the Committee . He will check with them and see if they want a person to attend the meeting. Mrs . Ice asked for signatures on the revised I/A Monitoring regulation . Dr . Scherzo spoke about the Brewster Woods housing project. They will be installing a Bioclere I/A system . He thought the Board would like to know that. The ZBA application remains open and further comments can still be submitted by interested parties . Dr. Scherzo also stated that the Board of Health has oversight of the operation, maintenance, monitoring and function of the I/A septic system once it' s installed . Informational items were noted .
