RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
DAVID CHRISTINSON AND GAIL CHRISTINSON
WHEREAS, David Christinson and Gail Christinson (Applicants) have applied
for a conditional use permit for a residential dog kennel at the property at
4072 Hamel Road; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on
July 12, 1988, and by the City Council on August 2, 1988; and
WHEREAS, it has been determined that the existence of a residential dog
kennel on this property will not impede the orderly development of adjacent
properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicants for the
stated purpose, subject to the following terms and conditions:
1. All dogs shall be under restraint or supervision at all times;
2. The total number of adult dogs to be allowed on the property shall
not exceed eight, with a maximum of three dogs over ten pounds in
weight. Puppies less than six months old shall be permitted in any
number provided they are the offspring of adult dogs legally on the
property;
3. All waste material shall be disposed of in accordance with the
City's ordinances and the regulations of the Minnesota pollution
control agency;
4. No dogs shall be sold or used for experimental purposes;
5. The Applicants shall take immediate steps to abate any noise
nuisance on the property, which shall include but not be limited to
ten minutes of continuous barking;
6. A11 dogs shall be maintained in accordance with the standards of the
Minnesota purebred dog breeders association;
7. There shall be no boarding of dogs on the property;
8. The Applicants shall maintain accurate records regarding the date,
number, sire or dam or each litter whelped or maintained on the
property, which records shall be available for inspection by city
staff at reasonable times; and
9. The Applicants shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
