Chairman ' s announcements The VNA in conjunction with the Brewster Board of Health will hold a blood pressure, glucose and cholesterol screening on Tuesday November 28, 2017 from L OAM until 2PM at the Brewster Ladies Library. Residents can contact the VNA at 508 -957-7423 for more information. Nancy Ellis Ice and Sherrie McCullough will be attending MHOA conference this week. Dr . Scherzo wished everyone a Happy Thanksgiving , 2 . Reorganization of the Board Motion : Nominate Joe Ford for Vice Chairman Motion : Annette Graczewski Second : Mary Chaffee Vote : 4-O-O Action : Motion carried 3 . J.M. O 'Reilly & Associates — local variance request for 59 Jolly 's Crossing i John O ' Reilly presented this to the Board . The home is currently for sale . A septic inspection conditionally passed because the tank outlet cover is way below finished grade and leaching is within 300 feet of pond . They would like to keep existing system where it is . The system is in good working order with 2 leaching pits (the one closest to the pond was not inspected due to it being under a retaining wall) . Separation to groundwater from bottom of leach field is 18 . 5 feet . Dr. Scherzo asked how far below grade the tank cover was . Mr. O 'Reilly stated that the tank is about 11 feet below grade . Mrs . Graczewski asked if Mr. O ' Reilly had seen the interior or any components of the leaching pit closest to the pond . Mr. O ' Reilly stated that he did not but did stated that in looking at the d-box, the flow was distributed evenly. Dr. Chaffee stated that the system is very old and the land is a couple of parcels away from one of the town ' s beaches . Mr . O ' Reilly stated that the leach pit that is furthest away is just about as close to the property line as allowed . There wouldn 't be anywhere to move it without being in the 300 foot area . Mr. Ford asked if this was a year round or seasonal home . Mr . O 'Reilly stated that it is currently being used part time but is being sold so it could become a full time home . The system is sized for a 5 bedroom home . WW W. BREWSTER-MA . GOV BOH 11 / 15/ 17 Meeting Page 2 Mrs . Graczewski asked about pumping records . Mr. O'Reilly believes on the report there is one pumping identified . It was last pumped after the inspection . The tank didn 't need it but the owner wanted to do it anyway. Mr. Ford stated that he thinks due to the age of the system he wouldn 't feel comfortable approving this variance. Dr. Chaffee stated that she felt this was a tough one, system is not failed and is not in bad shape, but it is old . Dr. Scherzo stated that groundwater is flowing away from the pond . Mrs . Graczewski asked if the cover would be brought up . Mr . O ' Reilly stated that it would . Motion : Finding that the system is not in failure, there is greater than an 18 foot separation from groundwater and the water is flowing away from the pond, approve the variance request for the leaching facility to remain 182 feet from the pond . The repair work must also be done . Motion : Mary Chaffee Second : Annette Graczewski Vote : 3 - 1 -0 Action : Motion carried 4. Ryder & Wilcox — discuss a proposed septic upgrade for 162 Owl Pond Road Stephanie Sequin presented this to the Board . In February of this year, the owners came before the board for a variance to leave the system where it is currently. The system is in good working order and the D-box was replaced . There is an issue with the floor plan . The Board stated in February that they wanted the system to be upgraded because there was more bedrooms than the septic allowed for . Before they go ahead with final plans, they want to see about where to put the system because it is too close to 2 ponds . She stated that the groundwater flow is in a north east direction . From the proposed leaching, groundwater would flow away from owl pond and more toward Lee ' s pond and it would be approximately 180 feet from Lee ' s pond . Dr. Chaffee asked Mrs . Ice about a similar situation that had previously been before the Board . Mr. Ford stated that he was comfortable with granting the request. Dr. Scherzo and Mrs . Graczewski agree with Mr. Ford. Mrs . Sequin asked if the Board would require an UA system . The Board said no . 5. Public hearing on changes to the Monitoring of UA on-site sewage treatment systems George Heufelder was present for this conversation . Dr. Chaffee talked about clarifying this specific section (addition of fines) and she thinks it is very clear about what will happen if the regulation is not complied with . Mr. Heufelder stated that he was glad this is being done. It helps the county help the department. The regulation should not reference the BCH department. He talked about a registration program that could be included in the regulation and stated that they did ask DEP to insert it into their regulation . The Board agreed to put the registration program on another agenda for discussion and invite Brian Baumgartel in so he can show the Board the forms . Dr. Scherzo asked if Mr . Heufelder could come up with a sample regulation . Mr. Heufelder said he could . The Board agreed that it should be a separate regulation and not included in the I/A one . Mr. Heufelder gave an update on the 319 grant. He stated that he was not sure where funding was going to come from . Motion : Joe Ford Second : Annette Graczewski Vote : 4-0- 0 Action : Motion carried A summary will appear in the paper before it goes into effect. 6. Discuss Zoning Board of Appeals application for Brewster Woods Dr. Scherzo stated that local regulations are mute . State regulations are the ones that have to be used . ZBA is the avenue with which this board needs to give any concerns . Dr . Scherzo handed out a brief summary he had written about this . Dr . Chaffee stated that she thinks that this should be consistent with the previous 40B projects that have been installed . Motion Recommend that the ZBA require a Nitrogen Limiting I/A System that would be consistent with other 40B projects in Brewster . Dr. Scherzo will submit something in writing to the ZBA by Friday November 17, 2017 . Motion : Annette Graczewski Second : Mary Chaffee Vote : 4-0-0 Action : Motion carried 7 . Discuss changes to State Private Well regulation and possibly change Town ' s regulations Mrs . Ice explained that she had gone to the annual Health Officers seminar and learned that in the States revised regulations, they took out the line that says that abutters have to be notified about a well installation . She would like to ask the board to remove that from the Town ' s regulations also . Motion : Leave the requirement to notify abutters of a well installation in the Town ' s regulations . Motion : Annette Graczewski Second : Mary Chaffee Vote : 4-0-0 Action : Motion carried 8 . Topics the Chairman did not anticipate Mrs . Graczewski brought up the potential Marijuana regulations and thought the Board should discuss it so they could help guide the Town . Dr . Scherzo stated that the Health Director' s evaluation had been done . Informational items were noted . Meeting adjourned at 8 : 45
