(/ r lO RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALISON WINKLER AND JOHN WINKLER WHEREAS, Alison Winkler and John Winkler (Applicants) have applied for a conditional use permit for a residential dog kennel at the property at 630 Shawnee Woods Road; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on July 12, 1988, and by the City Council on August 2, 1988; and WHEREAS, it has been determined that the existence of a residential dog kennel on the property will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. All dogs shall be restrained or under voice command at all times; 2. The total number of dogs of breedable age kept on the property shall not exceed four. Any number of puppies eight weeks of age or less shall be permitted so long as they are the offspring of adult dogs legally on the property; 3. All waste materials shall be disposed of in accordance with the City's ordinances and the regulations of the Minnesota pollution control agency; 4. No dogs shall be sold or used for experimental purposes; 5. The Applicants shall take immediate steps to abate any noise nuisance on the property, which shall include but not be limited to ten minutes of continuous barking; 6. A11 dogs shall be maintained in accordance with the standards of the Minnesota purebred dog breeders association; 7. A fourth adult dog may be on the premises if it is from the Long Lake Hounds and is there for whelping purposes; 8. The Applicants shall maintain accurate records regarding the date, number, sire and dam of each litter whelped or maintained on the property, which records shall be available for inspection by the city staff at reasonable times; and 9. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
