HomeMy Public PortalAbout1980-05-27 MeetingCOUNCIL MINUTES May 27, 1980 The Council of Bal Harbour Village met Tuesday, May 27, 1980 at 9:30 A. M. at the Village Hall. Present: Messrs. Printup and Taplin and Miss Gray Absent: Messrs. Beatty and Krez Also present were: Fred Maley, Village Manager; Alan Gold, Village Attorney; and Betty Carver, Deputy Village Clerk. On motion by Mr. Taplin, seconded by Miss Gray, the minutes of the Council Meeting of April 29, 1980, were approved as submitted. A Public Hearing was called for proposed Ordinance Nos. 215 and 216. All interested parties were invited to comment. None were received. Ordinance No. 215, requiring Civilian Registration of all persons employed in Bal Harbour, as amended on first reading, was read by Mr. Gold, by title only. It was moved by Mr. Taplin, seconded by Miss Gray and voted to adopt Ordinance No. 215 as amended. The second reading of Ordinance No. 216, establishing new beach rules and regulations was read by Mr. Gold. On motion by Miss Gray, seconded by Mr. Taplin and unanimously voted, Ordinance No. 216 was adopted as amended. Mr. Maley stated that Mr. Gold has recommended that we offer the City of North Miami Beach, through Rules of the Court, a settlement on the water rate case. He further stated that the offer has been approved by Bay Harbor Islands administration. The recommended settlement offer should be 4W 1.,000 gallons, in lieu of the 2W1,000 gallons which we have paid, and the 60</1,000 gallons which North Miami Beach wanted. Mr. Gold stated that it would be necessary to prepare "an Offer of Judgement", to be presented by the City of North Miami Beach, in which they have 60 days to accept. Mr. Gold stated that from his informal discussions with the City Attorney for North Miami Beach, it would appear that the Offer would be accepted. The offer, with interest, would amount: to approximately $586,000, of which our portion would be $315,516. The offer was approved. Mr. Maley stated that Dade County would be opening bids on June 12, 1980, for the purchase of water pipe for the proposed new water line for Bay Harbor Islands and Bal Harbour, and later this summer they would open bids for the laying of the water pipe. The Council considered the statements for the first six months' operation of all departments. After discussion, on motion of Miss Gray, seconded by Mr. Taplin and vote, the statements were filed for audit. Mr. Maley stated that bids for the street lighting improve- ments for the Residential District were opened at 9;30 A.M., May 27, 1980 Friday, May 20, 1980 in his office. Three bids were received. They were: Tri-State Electric - $195,000; Superior Electrical Contractors - - $197,500; and Astor -White Electric - $227,000. Mr. Maley explained that the specifications for the bid re- quired a particular fixture and bracket, both manufactured by the same manufacturer, thereby eliminating competition on the type of fixtures and brackets which could be installed. The engineers are now looking into possible alternates, as the fix- tures amount to $57,000 of the bid. Mr. Emmett Holloway of Stinson & Martinez, P. E., stated that their firm is contacting the manufacturer to see if the cost of the fixture and bracket can be reduced. After discussion, Mr. Taplin stated that unless the manufacturer specified will reduce the price, the fixture and bracket protion of the job should be re -bid. Mr. Maley was instructed by the Council to see what he could do about the price. The bid was awarded to the low bidder, pending re- solution of the best price on the fixture. A variance was granted to Kenilworth, Ltd. to construct a pool supply room on the existing pool deck, but going into the south set -back line. Mr. Taplin made the motion to grant the variance, seconded by Miss Gray, and unanimously voted. (On June 2, 1980, a letter from the adjacent property owner was received stating no objection to this construction.) Mr. Maley was instructed by the Council to contact the Dade County Delegation to the Florida Legislature opposing part of the "Surface Transportation Bill, Chapter 323", which authorizes county wide regulation of vehicles for hire (taxi cabs) in lieu of municipal control. The first reading of Proposed Ordinance No. 217, adopting a new procedure for consideration of non-use variances as part of our Zoning Code was postponed until the next Council meeting. Mr. Maley reported on the preliminary findings of Arthur Andersen & Co., CPA, with reference to the proposed new sewer rates. He stated that the new rates should go into effect by August, and thathe would recommend a flat rate rather than a gallonage use rate. These rates are estimated at $3.00 per month per hotel room or apartment, and approximately $6.00 to $7.50 per month for single family residences. A preliminary ordinance will be presented at the June meeting. The hotels will be advised prior to the meeting, so they can be informed of the rate change. The meeting was adjourned at 10:25 A.M.
