RESOLUTION GRANTING A VARIANCE FOR JOSEPH MALCHOW WHEREAS, Joseph Malchow (Applicant) has requested a variance to reduce the setback from the lakeshore from 75 feet to 54 feet for a deck on his house at 3087 Lakeshore Ave., which is legally described in Lot 4 and adjoining beach, Block 8, Independence Beach, Hennepin County, Minnesota; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request on July 12, 1988, and recommended approval thereof, with conditions; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance be granted, subject to the following conditions: 1. The deck must be constructed in full compliance with the building code; 2. The fence on the property must be in compliance with the building code; and 3. The deck shall not be enclosed or covered with any form of roof. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance granted hereby is justified by the small size of the lot, the location of the existing house and the fact that the deck setback will be consistent with neighborhood standards.
