HomeMy Public PortalAbout1988-069Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. i7 — RESOLUTION GRANTING A CONDITIONAI. USE PERMIT TO DeVAC, INC. WHEREAS, DeVac, Inc. (Applicant) has applied for a conditional use permit to construct an industrial facility at 4365 Willow Drive; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on June 14, July 12 and August 9, 1988, and by the City Council on August 1 and August 16, 1988; and WHEREAS, it has been determined that the construction of the proposed industrial building will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. There shall be no exterior storage on the site, except for outdoor trailers which shall not exceed eight; 2. The exterior building materials shall be as shown on the plans submitted to the city and shall be in compliance with the city's performance standards; 3. All signs on the site shall be in compliance with city ordinances; 4. Exterior trash storage shall be screened as shown on the plans submitted to the city; 5. Mechanical equipment shall be located on the roof so as to eliminate the need for screening; 6. The landscaping shall be installed as shown on the plans submitted to the city; 7. The parking shall be installed as shown on the plans submitted to the city; 8. Hard surface cover on the site shall be as shown on the plans submitted to the city; 9. Hours of operation for the industrial facility shall be 24 hours per day, seven days per week; 10. The maximum number of employees in the site shall be 160; 11. Exterior lighting shall be within enclosed lighting boxes, except for the light at the loading dock; 12. Site drainage shall be accomplished as shown on plans submitted to the city; 13. The Applicant shall dedicate to the city the drainage and utility easements required by the city engineer; 14. There shall be no outdoor speakers on the site; 15. The Applicant shall dedicate to the city the right-of-way for T.H. 55, Temroc Road and Willow Drive required by the city engineer, including 25 feet of right-of-way for T.H. 55; 16. Access to T.H. 55 through the property which the Applicant is currently attempting to purchase shall not be used; 17. The drainage plan for the site shall include 0utlots A and C; 18. The Applicant shall obtain approval for the plan from the Watershed District; 19. The Applicant shall install blacktop on the property in accordance with city codes, including 9 ton in the loading area; 20. The city staff and city engineer shall review all plans submitted by the Applicant for compliance with city codes and the intent of the city council as expressed in the minutes of city council meetings and this resolution; 21. The fire department shall review the height of the lab area; 22. No grading or utility permits shall be issued until the Applicant has submitted building plans to the city which are sufficient to assure the building inspector of code compliance. The Applicant shall submit full building plans thereafter, which plans shall not vary from the preliminary plans in any material respect regarding exterior design or building size. 23. Any future expansion of the building shall meet all city codes; 2 24. The Applicant shall execute a document in a form satisfactory to the city attorney which acknowledges that the Applicant shall not attempt to use the existence of the variances granted by the city in connection with the approval of the site plan for the purposes of condemnation related damages associated with future work on T.H. 55; and 25. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that the following variances be granted: A. 25-foot variance to T.H. 55 for building overhang; B. 25-foot south side yard variance for parking area, which is to be bermed and screened; C. 37.5-foot front yard variance towards T.H. 55 for driveway areas, which are to be bermed and landscaped; D. 11-foot height variance for the lab portion of the building; and E. 4-foot height variance at the loading docks, conditioned upon the truck wells having retaining walls, not a slope, and the variance being limited to 195 feet of loading area.
