HomeMy Public PortalAbout1988-075Member its adoption: -Lye} introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. SY RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ROGER P. SCHMIDT FOR LOTS 9 AND 10, PLAT OF HAMEL WHEREAS, Roger P. Schmidt (Applicant) has applied for a conditional use permit to allow a change of use in the building located at 122 Hamel Road, which is legally described as Lots 9 and 10, Plat of Hamel, Hennepin County, Minnesota; and WHEREAS, the Applicant is proposing that the structure be a mixed use building with residential on the second floor and retail commercial on the first floor; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on June 14, 1988, and August 9, 1988, and by the City Council on September 6, 1988; and WHEREAS, it has been determined that the proposed change of use will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant shall combine Lots 9 and 10, Plat of Hamel for tax purposes; 2. The Applicant shall install blacktopping in accordance with the plans approved by the city no later than September 30, 1991; 3. The Applicant shall comply with the standards of the Minnesota PCA regarding abandonment of fuel storage tanks; 4. The Applicant shall obtain a certificate of well closure from the appropriate authority and submit a copy thereof to the City; 5. The Applicant acknowledges that the front balcony on the road right-of-way cannot be enclosed, improved or replaced; 6. The building shall meet occupancy codes; 7. A11 signs on the property shall be in compliance with city ordinances; 8. Any commercial use within the building shall apply to the zoning administrator for an administrative conditional use permit; 9. The exterior of the building shall be in compliance with the city`s performance standards; 10. The Applicant shall maintain the existing landscaping and shall replace any dead or diseased material; 11. The storage building located on the property shall be in compliance with all setback requirements; 12. The trash receptacle shall be screened from view from all adjacent properties and roadways; and 13. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. Dated: ).4:r2 9 , 1988.
