HomeMy Public PortalAbout1988-078Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. /?,F RESOLUTION GRANTING A VARIANCE FOR DOUGLAS OLSON AND MARIJO OLSON WHEREAS, Douglas Olson and Marijo Olson (Applicants) have requested a variance to reduce the minimum lot size from 9,000 square feet to 5,700 square feet for a single family residential parcel located in the urban residential district, which property is legally described as Lot 22, Block 2 Independence Beach, Hennepin County, Minnesota; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat., Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance to reduce the minimum lot size of the above property from 9,000 square feet to 5,700 square feet is hereby granted on the grounds that there is no adjacent undeveloped property which may be added to the lot and a sewer and water connection charge has previously been assessed against the property, subject to the following conditions: 1. A11 buildings constructed on the property must comply with setback requirements; 2. The Applicants shall work with the city staff to resolve issues involving the drainage easement and the pipe to be on the east side of the lot; 3. The city recognizes that fill has been placed on the lot; 4. The variance shall be valid for a period of one year following the date of adoption of this resolution and shall be null and void thereafter unless the property is developed by construction of the proposed struc- ture; and 5. The Applicants shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this variance application.
