SCHMIDT FOR LOTS 7 AND 8, PLAT OF HAMEL WHEREAS, Roger P. Schmidt (Applicant) has applied for a conditional use permit for the property located at 112 Hamel Road, which is legally described as Lots 7 and 8, Plat of Hamel, Hennepin County, Minnesota; and WHEREAS, the City has previously issued a conditional use permit to the Applicant regarding the subject property; and WHEREAS, this matter has been reviewed by the planning commission on August 9, 1988, and by the City Council on September 6, 1988. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the subject property, subject to the following terms and conditions: 1. The exterior of the 70' x 54' building shall be in compliance with the city ordinances; 2. There shall be no exterior storage on the site; 3. All signs on the property shall be in compliance with city ordinances; 4. All trash containers shall be stored within the building; 5. The Applicant shall install landscaping in compliance with the requirements of the city ordinance, with credit to be given for the two existing boulevard trees. All landscaping shall be maintained and dead or diseased material shall be replaced; 6. The parking shown on the plan approved by the city meets code requirements for the existing use of the 70' x 54' building; 7. Hard surface coverage of the site shall be in compliance with ordinance requirements; 8. Hours of operation shall be limited to 7 a.m. to 7 p.m., seven days a week; 9. There shall be no exterior lighting on the site; 10. The conditional use permit approved through the adoption of this resolution supersedes the conditional use permit previously granted to the Applicant for the subject property through resolution number 75-29; and 11. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that a variance is hereby granted from the requirement of the zoning ordinance that no lot contain more than one principal structure to allow the Applicant to retain the small building located on Lot 7, Plat of Hamel until July 1, 1992, the destruction of the building to more than 50 percent of its value or the sale of the property or business occupying the site by the Applicant, whichever shall occur first.
