RESOLUTION NO. O E"- p 3
RESOLUTION VACATING AN
EASEMENT FOR A PUBLIC ROAD
WHEREAS, the city council of the City of Medina, Minnesota, on the

day of September, 1988, authorized the city clerk -treasurer to cause a notice
of a hearing regarding the vacation of a portion of an easement for a public
road over a portion of Lakeshore Avenue to be published in the official
newspaper and to be posted in the area of the affected property at least two
weeks prior to the public hearing; and
WHEREAS, the notice of the hearing was published on the 13th day of
September, 1988, in the official newspaper, and was posted in the area of the
affected property; and
WHEREAS, the city council has determined that it is in the public's
interest that a portion of said easement for a public road be vacated; and
WHEREAS, the city council held a public hearing on the vacation of a
portion of said easement for a public road on the 27th day of September, 1988,
at 8 o'clock p.m., in the council chambers at city hall, which public hearing
provided the opportunity for all interested persons to be heard with respect
to said vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The following easement is hereby vacated:
That part of the 40.00 foot public road easement described in Document
No. 2907575 in Book 2020 of deeds, page 129, which falls within the
following described real property, located in the County of Hennepin,
State of Minnesota and legally described as follows:
That part of Government Lot 2, Section 18, Township 118
North, Range 23 West of the 5th Principal Meridian,
described as follows:
Commencing at the Southeast corner of said
Government Lot 2; thence on an assumed bearing
of West along the South line of said Government
Lot 2 a distance of 396 feet; thence on a
bearing of North a distance of 297 feet; thence
North 70 degrees West a distance of 20.50 feet
to the point of beginning of the property being
described; thence continuing North 70 degrees
West a distance of 100 feet; thence South 20
degrees West to the shore of Lake Independence;
thence Southeasterly along said shore to its
intersection with a line drawn South 20 degrees
West through the point of beginning; thence
North 20 degrees East to the point of beginning,
EXCEPT that part of the above described property
described as follows:
beginning at the point of beginning of
the above described property; thence
North 70 degrees West a distance of
17.25 feet; thence South 20 degrees
West a distance of 84.52 feet; thence
South 48 degrees 45 minutes East a
distance of 8.24 feet; thence South 20
degrees East to an intersection with a
line drawn South 20 degrees West from
the point of beginning; thence North
20 degrees East to the point of
beginning,
which lies Southwesterly of the Southwesterly line of Block 29,
"Independence Beach, Hennepin County, Minnesota".
Nothing in this vacation proceeding shall affect or impair the
validity of the utility easements created in and evidenced by
Hennepin County Recorder Document Nos. 4395545, 4223184, 4225806,
and 4217956.
2. The city clerk -treasurer is hereby authorized and directed to
prepare and present to the Hennepin County auditor and the Hennepin
County recorder a recordable notice that the city council has
completed these vacation proceedings.
