The Council of Bal Harbour Village met Tuesday, July
29, 1980 at 9:30 A. M. in the suditorium of the Church By
The Sea.
Present: Miss Gray and Messrs. Krez, Printup and Taplin
Absent: Mr. Beatty
Also present were Fred W. Maley, Village Manager; Mary
T. Wetterer, Village Clerk; and Alan S. Gold, Village
Attorney.
On motion of Mr. Taplin, seconded by Miss Gray and voted
the minutes of June 24, 1980 were approved with the addition
of the phrase "for the expansion of building 'B' only" to
the motion on the variance for Bal Harbour Shops.
A Public Hearing was held to consider a traffic sur-
vey for the proposed addition to the Bal Harbour Shops.
Mr. Maley explained the traffic survey was the same as that
used for the expansion of the parking garage and showed that
the traffic level would not be below level "D" as described
in the zoning code. Mr. Whitman of Bal Harbour Shops asked
if it was necessary to have a public hearing every time the
shopping center is expanded. On Mr. Gol_d's advice it was
moved by Mr. Taplin, seconded by Mr. Krez and voted that
the traffic survey be accepted and would be valid for one
year for future expansion of the Bal Harbour Shops.
Mr. Gold told the council that the Offer of Judgement
tendered the City of North Miami Beach by Bal Harbour and
Bay Harbor Islands had been accepted and we have a settle-
ment and contract with North Miami Beach until we receive
water service from Dade County Water and Sewer Authority.
Mr. Maley reported that he had been in contact with
Kruse, O'Connor and Ling, our pension actuaries, regarding
their proposal for revising our pension plan and that the
fee had been reduced from $3,400 to $2,650. It was moved
by Mr. Krez, seconded by Miss Gray and voted that Kruse,
O'Connor and Ling be authorized to proceed with the changes
to the plan and processing it through all necessary agencies.
Mr. Maley said Head -Beckham Insurance Agency had sub-
mitted a quote of $5,500 for an umbrella policy to increase
our liability insurance $1,000,000. It was moved by Mr.
Taplin, seconded by Mr. Krez and voted to purchase this
additional coverage.
Mr. Gold read Ordinance No. 217, setting non-use
variance procedures. On motion of Miss Gray, seconded by
Mr. Krez and voted
Ordinance No. 217
was adopted on second reading.

Mr. Mark Hammer of the Balmoral Apartments spoke re-
garding the inequity in the voting districts in the village.
Other residents from the oceanfront district spoke both for
and against any change in the council districts. It was
moved by Mr. Taplin, seconded by Mr. Krez and voted that
Mr. Gold and Mr. Maley should prepare a new plan for the
five council districts in the Village which would provide
the oceanfront residents with two seats and the single
family and apartment districts on the west side of Collins
would have three seats.
Mr. Gold read Ordinance No 218. by title, amending the
zoning code to correct the omission of two lots during co-
dification. On motion of Mr. Taplin, seconded by Miss Gray
and voted the ordinance was passed on first reading.
Mr. Maley explained that the present cost of 6 per
thousand gallons to dispose of our sanitary sewage through
the City of Miami Beach outfall will be raised to 44 per
thousand gallons to have it pumped to the Virginia Key treat-
ment plant. He said that from a study done by Arthur Anderson
& Co. a monthly rate for disposal has been established at
$2.00 per apartment or hotel room; $4.00 for a single family
residence; and 35 per 1000 gallon, based on water use, for
commercial properties. By subsidizing the sewer department
33% the rates will produce sufficient income to run the
department. Mr. Gold read Ordinance No. 219, setting the
sewage rates, by title. On motion of Mr. Taplin, seconded
by Miss Gray and voted the ordinance was adopted on first
reading.
The council agreed to hold the reading of Ordinance
No. 220, providing for cable television franchises until
next month.
Mr. Herb Kaplan of the Sheraton Bal Harbour hotel
offered his resignation from the Resort Tax Advisory
Committee and requested the council to consider Mr. Mike
Brennan, Marketing Director of the Sheraton, as his re-
placement. On motion of Mr. Taplin, seconded by Mr. Krez
and voted Mr. Kaplan's resignation was accepted and Mr.
Brennan was appointed to the Resort Tax Advisory Committee.
The statements for nine months operation of all depart-
ments were deferred pending clarification of an expenditure
figure.
Mr. Maley announced that Dade County has taken bids
for the new water line to serve Bal Harbour and Bay Harbor
Islands and it is anticipated that by this time next year
we will be on the new line.
Mr. Maley explained that the present pension plan is
written for long term employees and showed how it effects
those hired at an early age against those hired who are
older. He recommended an alternate plan be provided for
the named positions of Village Manager, Village Clerk,
Chief of Police and Public Works Director. Mr. Maley was
asked to prepare some figures on an alternate plan for
next council meeting.

In answer to a question regarding the beach from a
resident it was explained that each ocean-
front owner is responsible for taking care of the private
property behind the dune to the seawall and that the village
crew had removed two truckloads of rock from the shallow
water. Also that busses waiting to load in front of the
hotels will be reminded that they must use their flashers
when parked.
It was moved by Mr. Krez, seconded by Mr. Taplin and
voted that $5,000 should be allocated for a lighting design
consultant for Collins Avenue Street lighting and Mr. Maley
should get proposals for the next meeting under Competitive
Negotiations Act.
On motion of Miss Gray, seconded by Mr. Taplin and
voted the meeting was adjourned at 11:40-,A.M.

The council of Bal Harbour Village met Tuesday, August 26,
1980 at 9:30 A.M. in the auditorium of the Church by the Sea.
Present: Messrs. Beatty, Krez, and Printup and Miss Gray
Absent: Mr. Taplin
Also Present were Fred W. Maley, Village Manager; Mary Wetterer,
Village Clerk; and Cliff Schulman, representing the Village
Attorney.
On Motion of Mr. Beatty, seconded by Mr. Krez and voted the
minutes of July 29, 1980 were approved as submitted.
Ordinance No. 218
correcting an omission in the Zoning Code was read in full by the
Village Clerk. On motion of Mr. Krez, seconded by Miss Gray and
voted the Ordinance was adopted on second reading.
Ordinance No. 219
establishing sewer service charges was read in full by the Village
Clerk. On Motion of Mr. Beatty, seconded by Miss Gray and voted
the Ordinance was adopted on second reading.
The council considered the nine month's operating statements
and on motion of Mr. Krez, seconded by Miss Gray and voted the
