HomeMy Public PortalAbout1988-089Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. �' a RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JOHN DAY WHEREAS, John Day (Applicant) has applied for a conditional use permit for construction of an addition to an office -warehouse facility on property legally described as lots 7 and 8, block 2, Medina Industrial Second Addition, Hennepin County, Minnesota; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on July 12, 1988, and by the City Council on August 2, 1988; and WHEREAS, it has been determined that the existence of the proposed addition will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant shall combine lots 7 and 8, block 2, Medina Industrial Addition; 2. There shall be no exterior storage on the site; 3. The exterior of the addition shall be of the same or similar decorative block to match the existing building and shall also meet code; 4. Any signs on the property shall meet city code; 5. There shall be no exterior trash container on the property; 6. A11 mechanical equipment shall be screened from view from adjacent properties and roadways; 7. The landscaping shall be installed as shown on the plan submitted to the city; 8. Parking shall be installed as shown on the plan submitted to the city; 9. The blacktop on the north lot and the loading area shall be built to a 9-ton capacity and lot 8 shall be re-blacktopped; 10. The hard surface coverage of the property shall not exceed 60 percent; 11. The number of employees shall not exceed the available on -site parking; 12. Exterior lighting shall be designed and installed so as not to cast light onto adjacent parcels; 13. Site drainage shall be accomplished in accordance with staff recommendations; 14. There shall be no exterior loud speakers on the property; 15. Access to the site shall be accomplished in accordance with the plan submitted to the city; 16. The recessed loading area shall be constructed with a guard rail; 17. The Applicant shall maintain the landscaping and hard surface coverage as originally approved; 18. Staff is authorized to grant administrative conditional use permits for tenants in the building; and 19. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the Applicant be granted a variance from the provisions of Section 826.57 of the City Code to reduce side yard setback from 30 feet to 15 feet and to reduce front yard setback from 50 feet to 30 feet for the building addition. 2 Dated: (�-�r,y_2 , 1988.
