AN ORDINANCE PROVIDING FOR ALTERNATE MEMBERS OF THE
ZONING BOARD OF ADJUSTMENT
BE IT ORDAINED by the Mayor and Borough Council of the Borough of Cafteret, a
municipal corporation of the State of New Jersey, located in Middlesex County, thereof,
as fol1ows~ '
Section 1. The number of alternate members of the Zoning Board of Adjustment
shall be increased from two ,(2) to four (4) said members in accordance with N,lS.A.
40:55D-69, Hereafter, the alternate members shall be designated as Alt<;mate No,!,
Alternate No.2, Alternate No.3, and Alternate No.4, with the existing alternate
members being designated at Alternate No. 1 and Alternate No.2, respectively, in the
order of their current appointments, which are pre~ently s~t to expire on December 31,
2008, Beginning on January t, 2009, Alternates No, 1 and No, 2 shan be appointed for
an initial term of two (2) years, commencing on Janua.ry 1, 2909, and expiring on
December 31, 2010. Alternates No.3 and No.4, as created by this' ordinance, shall each
be appointed for'an initial term of one (1) year, commencing on January 1, 2009, and
expiring on December 31-,2009. Thereafter, the term of each alternate member shall be
two (2) years,
Section 2. All Ordinances and/or provisions thereof inconsistent with the provision of
this Ordinance shall be and are hereby repealed as to the ".extent of any such
inconsistencies. "
Section 3. If any se<;:tion, subsection, part, clause or phrase of this Ordinance shall be
declared invalid by judgment of any Court of competent jurisdiction, the section,
s\lbsection, part, clause or phrase shall be deemed to be sever able" tfom the remalnder of
this Ordinance.
Section 4. This Ordinance shall take effeCt upon passage and publication according to
applicable law,' ,
