RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
ALFRED MERZ AND KATHLEEN MERZ
WHEREAS, Alfred Merz and Kathleen Merz (Applicants) have applied for a
conditional use permit to allow two accessory structures totaling 2,375 square
feet of their property at 1852 Tamarack Drive which contains approximately
2.80 acres; and
WHEREAS, Section 825.19 of the the City's zoning ordinance limits acces-
sory structures on properties of less than 3 acres to one not more than 1,500
square feet in size; and
WHEREAS, this matter has been reviewed by the planning commission on
September 14, 1988, and by the City Council on October 4, 1988; and
WHEREAS, it has been determined that the existence of two accessory
structures totaling 2,375 square feet will not impede the orderly development
of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Medina,
Minnesota that a conditional use permit be granted to the Applicants for the
stated purpose, subject to the following terms and conditions:
1. The building shall be used for the Applicants' personal, non-
commercial use only;
2. There shall be no exterior storage on the site;
3. The exterior of the building shall be in compliance with all city
regulations;
4. There shall be no signs on the property;
5. Exterior trash containers shall be screened from view from adjacent
properties and streets;
6. Exterior lighting shall be designed and installed so as not to cast
light onto adjacent properties;
7. No noise shall be broadcast of the property between the hours of 10
p.m. and 6 a.m.;
8. There shall be no employees on the site;
9. The building shall be located at least 10 feet from all easements;
10. The Applicants shall demolish the old structure within 90 days of
completion of the new building or within six months of the issuance
of the building permit, whichever occurs first;
11. The Applicants shall grant an easement to the city for the right -of
way for Tamarack along the northern 132 feet of the property;
12. The existing garage shall be moved to the location depicted on the
survey submitted to the city;
13. Neither accessory building shall be used to house animals; and
14. The Applicant shall pay to the City a fee in the amount determined
by the staff to represent the actual cost to the City of reviewing
this conditional use permit application.
BE IT FURTHER RESOLVED By the City Council of the City of Medina that a
variance from the provisions of Section 825.19, subd. 3 of the City's zoning
ordinance be granted to the Applicants to allow them to have two accessory
buildings totaling 2,375 square feet.
